On March 20, 2021, Transport Canada presented two new Ministerial Orders, Order 21-01 and Order 21-02, which direct companies to implement safety measures and table changes to the Railway Locomotive Inspection and Safety Rules and the Canadian Rail Operating Rules.

Commercial vehicles that operate within a single province are regulated provincially. The Manitoba government adopts the majority of the federal hours of service regulations as part of the provincial Drivers Hours of Service Regulation (M.R. 72/2007) and is considering following Transport Canada’s lead in requiring electronic logging devices in provincially regulated vehicles.

A number of responsibilities have transferred from SaskPower to the Technical Safety Authority of Saskatchewan over the past few years to provide a single point of contact for permitting, inspections and licensing of safety related services in Saskatchewan. This transference of activities in addition to other updates necessitated changes to the Gas Inspections Act and Gas Inspections Regulations.

The Ministère des Transports reminds users of heavy vehicles and shippers that the authorized load limits are reduced during the thaw period on all public roads. This is done every year to account for the road network’s lower bearing capacity during this period.

Transport Canada has indicated it is firm on the June 2021 deadline for logging device requirements but specified that it will enforce the requirements through educational outreach for the initial 12 months. After the 12-month educational period, it would then move to a punitive approach.

On February 18, 2021, the CPA announced that we had contacted Transport Canada after receiving reports from members that TC had been requesting information to provide 20lb cylinder requalification reports to new owners upon purchase of a container. TC indicated that it understands this specific requirement is “quite onerous”, it also mentioned that Part 5 of the regulation is currently under review, which may provide an avenue to include changes to this requirement.

As members were recently informed, on February 11, 2021 the Ontario Ministry of the Environment, Conservation and Parks posted the proposed Hazardous and Special Products regulation, under the Resource Recovery and Circular Economy Act to transition the Municipal Hazardous and Special Waste Program to full producer responsibility.

CPA members had expressed difficulties with maintaining the planned pressure relief valve replacement schedule for 10-year and 25-year expiry of propane containers. Transport Canada has provided an extension of cylinders that fall under the Transportation of Dangerous Goods Act through the CPA’s temporary equivalency certificate TU 0807.  For 25-year PRV replacement schedules, the requirement and enforcement fall under provincial jurisdiction. As per O. Reg. 219/01: Operating Engineers, the Technical Standards and Safety Authority’s (TSSA) inspectors will no longer schedule inspections of non-emergency boiler and pressure vessels (BVP) or the work completed by operating engineers.
