FROM THE DESK OF THE PRESIDENT AND CEO
A common question following the adjournment of the General Assembly is, "Aren’t you glad it’s over?" And yes, to a certain degree I am glad the session is over but don’t forget the veto session is still scheduled for April 20 and the Governor has already vetoed 12 bills and it’s not the end of March as I write this.

Many health insurance agents are dealing with the decisions of most health plans in Virginia to suspend paying commissions on new or renewal individual business for the lifetime of the policyholder both inside or outside the Exchange as it relates to Special Enrollment Period "SEP" business. IIAV has met with Virginia Bureau of Insurance Commissioner Cunningham on this issue as well as responded to technical corrections to Health & Human Services Centers for Medicare & Medicaid Services (CMS).

No joke: April 1 brings a deluge of National Flood Insurance Program (NFIP) changes – changes that stem from federal reform legislation. All policyholders will be impacted, some significantly.

IIAV NEWS

We would like to know your opinion on the adequacy of funding of your fire department from the state Fire Program Fund.

Virtually every year legislation is introduced to increase funding for the Fire Program Fund and 2016 was no different with a proposal to increase the insurance premium tax by $14 million. As you know, the insurance premium tax is based on homeowners insurance written in the Commonwealth.

Any comments you might have, please send them to Bob Bradshaw – IIAV’s President & CEO at: rbradshaw@iiav.com

Without question IIAV is the key and virtually sole legislative organization representing insurance agents’ interests at the Virginia General Assembly. IIAV lobbies on behalf of our members on interest areas including Property/Casualty, Life/Health, Financial Services, Workers Compensation and safety. On occasion IIAV gets involved in legislation related to business operations such as when the association pursued efforts to reign in patent trolls.

Subcommittee to review "AirBNB" legislation

HB 812 introduced by Delegate Chris Peace and SB 416 introduced by Senator Jill Vogel would have established the Virginia Limited Residential Lodging Act which would allow primary residents of a home to rent out all or a portion of the home on a temporary basis and would provide procedures for the regulation and taxation of these transactions.

E&O SPOTLIGHT
Making mid-term policy changes is a normal part of the insurance agency business. In fact, it is so routine that there is a danger of making ordinary, perfunctory policy changes without considering the potential E&O exposure. In particular, there is a big E&O risk when making policy changes based on information or instructions (or lack of information or instructions) from third parties.
