Business organizations are pushing back against making Virginia’s COVID-19 workplace safety rules permanent, arguing that the regulations - rules that were temporarily adopted in July as an emergency measure - have proved costly, confusing and burdensome for companies.
"I ask you not to create a permanent solution to a temporary problem,” said Brandon Robinson, chief executive officer of the Associated General Contractors of Virginia, an organization of commercial construction companies. “I ask you not to adopt a one-size-fits-all approach. Every day the science behind this disease evolves as we learn more and devise better ways to keep people safe.”
The U.S. Department of Labor’s Wage and Hour Division (WHD) posted revisions to regulations that implemented the paid sick leave and expanded family and medical leave provisions of the Families First Coronavirus Response Act (FFCRA). The revisions come as a result of a federal court decision that found portions of the regulations invalid. Please click “learn more” for a discussion of the revisions.
Clarifies Employers’ Obligations to Track Compensable Hours
With telework arrangements expanding in response to the coronavirus pandemic, the U.S. Department of Labor’s Wage and Hour Division (WHD) issued Field Assistance Bulletin (FAB) 2020-5 to clarify an employer’s obligation to track the number of hours of compensable work by employees who are teleworking or otherwise working away from premises controlled by their employers. In a telework or remote work arrangement, the question of the employer’s obligation to track hours actually worked for which the employee was not scheduled may often arise. While the guidance issued responds directly to needs created by new telework or remote work arrangements that arose in response to COVID-19, it also applies to all telework or remote work arrangements.
Workforce Development
Rockbridge County High School went all remote for the first nine weeks of school, which works for many courses. But what about their Career and Technical Education? Things like electronics, or carpentry and building trades? Well, they’ve come up with a solution for those, too.
“We’re in an open air, outside, fresh-air environment, socially distancing, wear a mask, doing all the proper safety protocols and allowing kids to come in and get their hands dirty a little bit,” said Paige Owens, the Career and Technical Education supervisor.
Do you know students who are interested in a career in the construction industry? Students have until November 1, 2020 to apply for the AGC Education and Research Foundation scholarship.
