Supreme Court’s Pro-Business Ruling Highlights Importance of Trump Nominee

The Supreme Court’s 5-4 ruling last week that nonunion workers cannot be forced to pay fees to support unions underscores the importance of the Senate confirming President Trump’s Supreme Court nominee. In Janus v. AFSCME, the court held that forcing nonunion workers to pay an administrative fee that supports a union is a violation of the nonunion workers’ First Amendment right to free speech. While this decision applies only to public sector unions, the victory for free speech and association are important precedents to NRMCA priorities like ambush elections. In order to do this, it is imperative that we retain and expand a Republican majority in the U.S. Senate to confirm President Trump’s nominee Brett M. Kavanaugh to replace Justice Anthony Kennedy, who announced his retirement earlier this month week.

The narrow, 5-4 ruling shows just how critical it is that we have a Senate that will confirm conservative nominees like Justice Neil Gorsuch to the Supreme Court. Justice Gorsuch, whose nomination NRMCA strongly supported, was among the five justices that sided with the nonunion workers.
