CTA in Action: Government Affairs Update

CTA has been fighting to protect the industry from the "ABC test"  created by the Dynamex Supreme Court Decision even before AB 5 was introduced. In 2018, California Trucking Association (CTA) and two California independent owner-operator truck drivers sued the State of California to prevent the application of the “ABC” test to the trucking industry. The lawsuit is pending review and it argues that the Dynamex Decision should not be enforced because it is preempted under Federal Law. On November 12, CTA amended its lawsuit to add claims challenging AB 5 as well as asking for a preliminary injunction. The preliminary injunction would prevent the state from enforcing against the industry while our court case is ongoing. Compliance and Regulatory News

From Sept. 15-21, 2019, inspectors conducted 34,320 commercial motor vehicle inspections as part of the Commercial Vehicle Safety Alliance’s (CVSA) Brake Safety Week and placed 4,626 vehicles out of service after critical brake-related conditions were identified during roadside inspections. The majority of commercial motor vehicles inspected (86.5%) did not have any critical brake-related inspection item violations. Read Press Release

The Federal Motor Carrier Safety Administration (FMCSA) is in the process of reducing UCR registration fee levels for 2020 and 2021. The 2020 UCR registration period is delayed until the FMCSA publishes its final rulemaking officially establishing 2020 and 2021 UCR fees. The notice of proposed rulemaking is available here. Currently, the expected completion date for the rulemaking is unknown. Once the FMCSA publishes the final rulemaking, the UCR Board of Directors will recommend that states delay enforcement until three months after the start of the registration period. Twenty-six future leaders attended the event held November 6-7 at the TEC Equipment office in Fontana, CA.
