CTA in Action: Government Affairs Update
In 2004, the California Legislature passed the Private Attorneys General Act (PAGA), allowing aggrieved employees to hire private attorneys to act on behalf of the State, file lawsuits against their employer for any violation of the California Labor code, and recover penalties. Violations can include minor technical mistakes like pay stubs missing the start or end date of the pay period, or incorrectly documenting meal and rest breaks.
  
By now you may be aware of the attempts to delay the Electronic Logging Device (ELD) requirement that is set to be implemented nationwide in December of 2017. Intrastate adoption has until February of 2019 to be implemented in California, however, don’t rely on February being the deadline date. CHP could implement it before February.
FMCSA handed the trucking industry a significant victory this week when they announced a planned demonstration project to begin making preventability determinations on crashes meeting certain criteria and incorporating them into motor carriers’ CSA Safety Measurement System records. The announcement comes in response to comments by ATA on the Federal Motor Carrier Safety Administration’s 2015 Crash Weighting Study.

Effective May 10, 2017, pursuant to federal law, the Department of Motor Vehicles (DMV) will require all new and existing commercial driver license (CDL) applicants to provide DMV with the following:
  • Proof of U.S. citizenship/lawful permanent residency/legal presence
  • Proof of residency (domicile).
The new requirements apply to original and renewal CDL applicants, as well as CDL cardholders who request a license upgrade. Applicants who have started their CDL application, but have not completed the process by May 9, 2017, will be required to meet the new requirements.
