Government Affairs Update
 
The Senate Transportation Committee is scheduled to hear Assembly Bill 2406 today, June 14 at 1:30 pm.
 
AB 2406 by Assemblywoman Cecilia Aguiar-Curry seeks to protect California businesses from being charged excessive and unfair fees (detention/demurrage) by intermodal marine equipment providers for reasons outside the control of the business by clarifying and modernizing the protections set by SB 45 (Alarcon, 2005).
 
CTA is a co-sponsor of AB 2406 and has led a coalition of more than 60 organizations representing agricultural exporters, retailers, manufacturers, and other California based businesses.
 
Chris Shimoda, CTA’s Vice President of Government Affairs joins Assemblymember Aguiar-Curry as lead witness in support of this measure.
 
Additionally, the committee has made testifying via teleconference available for members interested in voicing their support.
The California Trucking Association (CTA) filed its brief challenging the Solicitor General’s recommendation to the U.S. Supreme Court to deny cert in CTA v Bonta, the Association’s case challenging California’s Assembly Bill 5 (AB 5) law.
 
The brief on emphasizes why the Court should take the case and explains the shortcomings in the Solicitor General’s recommendation to the Court not hear the case.
 
The Supreme Court’s conference is scheduled for June 23 at which point a vote to either hear or deny the case will  take place and position will be released on June 27.
 
There is also a possibility that the case may be relisted for the next conference scheduled for October 7.

Last Tuesday, California held its primary election to determine the candidates that will appear on the November 2022 General Election.
 
The surprise of the night came in Senate District 4 currently represented by long-term legislator Senator Jim Nielsen. Despite being a safe district for republicans, the vote was split between eight candidates – including six with the GOP – allowing the two remaining democrats to advance to the general election.  As a reminder, in California the top two vote-getters, regardless of party affiliation, advance to the general election.
 
This will add at least one additional seat the Democrat’s super majority in the Senate for a total of 32.
 
Moreover, there are five competitive races in the November Ballot; three slightly favor republican candidates, while the other two favor democrats. There will also be two democrat on democrat races Senate that pit business and labor against each other and impact the moderate / progressive make-up of the Senate Democratic caucus.
 
While the Assembly Democrats currently hold the 61-member super-majority, there are seven to nine competitive republicans versus democrat races that can further increase the size of the caucus.

I-80 will be COMPLETELY CLOSED between Battle Mountain exit 231 and Carlin exit 279 from 7 p.m. JUNE 18 and 6 a.m. June 19 as part of a Nevada Department of Transportation interstate improvement project. Closure date is subject to change.
