Government Affairs Update
 
FMCSA previously extended its waiver on May 31 to provide regulatory relief to commercial motor vehicle operations providing direct assistance in support of emergency relief efforts related to COVID-19 and is limited to the transportation of:
 
1.Livestock and livestock feed;
2.Medical supplies and equipment related to the testing, diagnosis, and treatment of COVID-19;
3.Vaccines, constituent products, and medical supplies and equipment, including ancillary supplies/kits for the administration of vaccines, related to the prevention of COVID-19;
4.Supplies and equipment necessary for community safety, sanitation, and prevention of community transmission of COVID-19 such as masks, gloves, hand sanitizer, soap, and disinfectants; and,
5.Food, paper products, and other groceries for emergency restocking of distribution centers or stores.
 
If the waivers are extended, CTA will update its membership.
The date changed for the California Air Resources Board's (CARB) virtual public workshop to review and discuss the proposed Advanced Clean Fleets (ACF) regulation. The workshop will be held on Thursday, September 9 from 9am-4pm via Zoom. You will need to re-register to attend the meeting.
 
The workshop discussion will focus on reviewing the proposed regulatory language and the cost implications to develop the Standardized Regulatory Impact Assessment (SRIA). This rulemaking is part of the transition to achieve zero-emission truck fleets by 2045.
 
You will have the opportunity to comment or ask questions related to the draft regulation language. The meeting materials will be posted in advance of the meeting closer to the workshop date.

Group Asks for Personal Conveyance Limits

The Commercial Vehicle Safety Alliance has petitioned FMCSA for a second time to more clearly define the term “personal conveyance” in hours of service regulations. It is asking the agency to add a maximum distance or time limit to the rules.

Arlington, Virginia – The American Transportation Research Institute launched a new data collection initiative to better understand the motivating factors for being an owner-operator, independent contractor, or company driver.  This research was identified by ATRI’s Research Advisory Committee as a top research priority in 2020.
 
Drivers are asked to provide input through an online data collection form that will measure what job-related factors contributed to becoming an owner-operator, independent contractor, or company driver and whether those expectations have been met.  This timely research will provide valuable insight into understanding how drivers could be impacted by legislative and regulatory actions that may impact the way in which drivers are classified.
 
“This ATRI data collection initiative will be critical to understanding why drivers choose the type of employment they do.  The motivations behind these choices and their level of satisfaction are important for understanding what types of employment opportunities drivers are looking for and why,” said Tom Weakley, OOIDA Foundation Director of Operations and a member of ATRI’s Research Advisory Committee.
 
Drivers are asked to complete the survey by Friday, September 17, 2021.  All submitted data will be kept strictly confidential and participants will receive an advance copy of the full report.
