On May 10th, hundreds from across the industry joined together at Quarry Oaks Golf Club in Ontario, California to support one of the most noble causes imagineable.

Last week, CFCA member, Rotten Robbie hosted the 2019 NCPI Golf Tournament at La Riconanda Country Club in Los Gatos California. 
 
CFCA was thrilled to attend and meet with numerous members and see all the happy faces ready for an amazing day of golf in what could only be described as perfect weather. Members of the industry came from across the country for this annual gathering at one of California's premier golfing venues in the heart of Silicon Valley.

CFCA member engagement was crucial in defeating the Bonta beverage coupon ban. Continued support from CFCA members by providing letters and personal testimony as constituents plays a vital role in CFCA mission to defend our industry. 
  

At this year's California Unified Program Agencies (CUPA) conference, CUPA and PG&E announced the formation of the Industry Technical Advisory Group (iTAG). CFCA has joined the iTAG, as well as the UST Subcommittee. This group was formed to provide industry input in order to streamline and clarify problems with CUPA.
 
The Industry Technical Advisory Group (iTAG) is scheduling a meeting with Laura Fisher of SWRCB to discuss the following issues:

  • UST - Lack of violation closure in CERS
  • Inconsistent CUPA requirements for when a permit is needed for overfill prevention systems or other UST component repair/replacements
  • Specificity requirements for CERS data (e.g. TLS-350 plus model requires "+")

Additionally, we are hoping to discuss the B20 rulemaking, especially the certification of components and fittings. If you have an issue you would like CFCA to address, please contact Sam Bayless (bayless@cfca.energy).

Q: Why will the state gas tax increase 5.6 cents per gallon on July 1? The closest answer I can find only left me confused.

A: It should. Under a complicated "tax swap" in 2010, the 7.25 percent sales tax on gasoline was repealed that eliminated all but 2.25 percent of the sales tax, most of which goes to public safety, local health and social service programs and city and county operations.
But the tax swap added a second, price-based, excise tax of 17.3 cents per gallon for a total of 35.3 cents per gallon. The trade-off was intended to raise about the same amount of money as the old system but since the new excise tax component is based on the price of gas, it is adjusted each July to retain revenue neutrality.
  
U.S. refiner PBF Energy Inc on Tuesday agreed to pay up to $1 billion for a California oil refinery that Royal Dutch Shell PLC has been trying to sell for at least four years.
 
Terms of the deal require Shell to pay about $70 million for turnaround costs anticipated in the first quarter of 2020, and about $40 million in compensation for downtime, if the deal does not close by the first quarter of 2020, PBF said in a presentation. 
 
The deal is expected to close by December and is expected to be "significantly accretive" to PBF's earnings and cash flow, the company said.
  
Before the workweek is over, California lawmakers will have done their constitutional duty to send a bill enacting a new state budget to Gov. Gavin Newsom. But make no mistake, it's unlikely to be the end of the story.
 
California budgets are like a long novel where we often only know the beginning and end at first, and only later do we see the inside chapters. That's one way of thinking about the framework of a plan lawmakers approved in Sacramento on Sunday night.
 
The proposal that now heads to the full state Senate and Assembly, probably on Thursday, sets the stage for a fiscal plan totaling at least $213 billion. Here are some key takeaways:
  
Work used to be much simpler for the California Department of Transportation: widen highways, fill potholes, build new freeways.
 
Alas, those quaint days are gone.
To get an idea of what planners must prepare for, state officials recently hosted a demonstration of a drone air taxi that will require devising a "highway above the ground," said Reza Navai, a Caltrans transportation planner. "If you think transportation on the ground is complex...."
 
Such sci-fi-like transit is one of many high-tech changes coming as California implements its planned electrification of transportation to radically reduce greenhouse-gas emissions. The path to zero, as in zero-emission vehicles, extends well beyond flying taxis and the 5 million electric cars the state hopes will be on its roads by 2030. 
  
Berry Petroleum, (NYSE:BRY) has just emerged from a period where they were acquired for $2.5 billion by a large independent, Linn Energy- which went bankrupt in 2016, thanks largely to the debt taken on in that transaction. In 2018 with new management, they re-entered the capital market with a midyear IPO.
 
It's been a tough market since then, and Berry currently stands at a ~40% discount to its $14.00 IPO price. Most of the decline has come in the last couple of months, where oil related issues have lost favor. Their first quarter results of $-0.42 EPS haven't helped either, particularly when compared with their Q-4, 2018 results of $1.52 per share. That all taken into account, we think it is oversold currently and represents an exceptional value at these levels.
