Punitive Damage Distribution and Caps - Punitive damages are designed to punish those who are found liable for wrong-doing. West Virginia should join other states and limit these damages, or redirect their use for a public benefit instead of an addition reward for plaintiffs.

 

Premises Liability - Premises owners and related entities would have an immunity defense for death or injury of independent contractors or employees of independent contractors. However, the independent contractor relationship has to be properly maintained. Premises owners would not be liable for injuries or deaths that arise from dangers of which the contractor knew, or reasonably should have known.
