Anti-speeding Devices get Gov. Youngkin’s OK

Starting next year, judges will have the option to mandate the installation of a speed-limiting device in a vehicle driven by anyone convicted of reckless driving and going over 100 mph. The speed control devices may be mandated in lieu of suspending a person’s license. The legislation takes effect July 1, 2026.
 
HB2096 also requires the Department of Motor Vehicles to offer written notice of enrollment in the program for anyone who has accumulated a certain number of DMV demerit points. If the person does not respond to the notice within 30 days, the bill requires the suspension of their license.
 
Those enrolled in the program must install an intelligent speed assistance system, at their expense, in vehicles owned or registered to them. They will also receive a restricted license and are prohibited from driving any vehicle without the device. The legislation also makes it a Class 1 misdemeanor to tamper with or attempt to bypass the system.

As of July 1, 2025, there is no change to the agent appointment and the appointment billing processes.

However, the $50/day mandatory penalty for late payment of appointment fees was repealed. Instead, late payments are subject to the penalty provisions prescribed in § 38.2-218 of the Code.

Sections 38.2-1833, 38.2-1834, and 38.2-1834.1 were amended to remove language addressing the agent appointment processes from Chapter 18 of Title 38.2 of the Code and to remove the $50 per day penalty. These amendments provide the Bureau of Insurance with the flexibility to establish a more efficient electronic process to bill and collect these fees in the future. See Chapter 481 (HB1778-2025).

Appointment Process Effective July 1, 2025
Insurance companies can submit appointments and terminations using the National Producer Number (NPN) in lieu of the Social Security Number (SSN) directly through the NIPR Gateway, or through one of NIPR’s Resellers (NIPR Resellers 4.2025.pdf). These transactions are validated with the Producer Database (PDB) prior to submission. NIPR transaction fees are due at the time of processing via credit card or electronic check. There is no fee for appointment terminations.

Appointment Billing Process Effective July 1, 2025
The Bureau will continue to bill insurers on a quarterly basis for new appointments submitted for the previous quarter and bill for appointment renewals annually on July 1. To review the appointment billing process, visit Virginia SCC - Appointment Billing Information.
