Q: We have an employee whose daughter's daycare reopened last week. Our employee wants to continue on Emergency Paid Family Leave (she has 4 weeks remaining) because she is afraid to send her daughter back to daycare. Would she be allowed to do this under the EPFL program?

A: If child care is available, but the employee chooses to not use it, then they would no longer be eligible for EPFL. Moreover, now that the school year is over and emergency stay-at-home orders are being lifted, employers should circle back with everyone on emergency paid leave and have them submit a new form/request for EPFL with documentation that their intended summer child care is not available.
