Michael L. Sterling, Managing Partner of the Vandeventer Black law firm, was selected as a Fellow in the Construction Lawyers Society of America (CLSA). The criteria for CLSA’s Fellowship of preeminent construction lawyers is a combination of Fellow input, independent and internal research, nominations by CLSA Fellows, attorney opinions, evaluation of client selection of counsel and reviews of acknowledgment and recognition by other peer reviewing sources and associations.

Scott Insurance has appointed Keith Man as the company’s new chief operating officer and chief financial officer.  Craig Ryder, who has served in those roles since 1994 for the Lynchburg-based insurance company, will retire at the end of the year. This transition concludes a multiyear planning and search process.


Mann joined Scott in July with 20 years of experience in corporate finance, accounting and leadership roles. A native of Lynchburg, he is a graduate of James Madison University where he majored in accounting and obtained a bachelor’s degree in business.  After college, Mann worked 10 years at Omni Electrical in Lynchburg before moving to leadership roles at Rubatex International and TRAX International. Most recently, he served as CFO of Schewel Furniture in Lynchburg.

Congratulations to Judge Mark Lambert of KBS, Inc. Mark Lambert has strategic and day to day responsibility for leading KBS’s safety department.  He heads the effort to promote and maintain safe, clean and efficient jobsites.  Lambert and his team carry out weekly project site visits, providing oversight and training for superintendent and subcontractors.

WM Jordan, receives VA BEST Level 1 Certification, program open to all GCs, will be open to Subcontractors beginning in 2018.  WM Jordan was recently recognized by the Virginia BEST Review Board and the Virginia Department of Labor for meeting the VA BEST Level 1 program requirements.  WM Jordan is the first firm to go through the process.  Scott Sutton, Director of Safety at WM Jordan, said “I am pleased with our team and everyone’s effort to get us to this point.  Just going through the process and exercises to meet the  of Virginia BEST, has made us an even better company.”


Subcontractors will be encouraged to apply in 2018.  The VA BEST Review Board and DOLI staff will make a presentation to the AGCVA Board on Thursday, January 18, 2018 at the Winter Convention.  Applications will be available at that time.  For more information, contact Gordon Dixon at gordon@agcva.org

New Deadline: December 15, 2017
On November 24, the Occupational Safety and Health Administration (OSHA) published a final rule extending the deadline for submitting injury and illness data to December 15 to allow affected entities sufficient time to familiarize themselves with the electronic reporting system. In August, OSHA launched the web-based Injury Tracking Application (ITA), which allows employers to electronically submit the required data from their completed 2016 OSHA Form 300A – the only information required for the 2017 submission. The application will be accessible from the ITA webpage.


The data submission process involves four steps: (1) Creating an establishment; (2) adding 300A summary data; (3) submitting data to OSHA; and (4) reviewing the confirmation email. The secure website offers three options for data submission. One option will enable users to manually enter data into a web form. Another option will give users the ability to upload a CSV file to process single or multiple establishments at the same time. A third option will allow users of automated recordkeeping systems to transmit data electronically via an application programming interface.

Plenty of news has been circulated about the U.S. Occupational Safety & Health Administration’s began full enforcement of its respirable crystalline silica standard for construction. AGC is working to help members become prepared to handle the compliance regulations.  AGCVA will offer Competent Person Training in all Districts for those interested and to help educate members, AGC developed the "Respirable Crystalline Silica in Construction" webpage with a host of resources—sample forms, webinars, flowcharts, FAQs, and more—to help AGC members understand their compliance responsibilities.


Most recently, AGC developed a silica inspection reporting form to track enforcement. OSHA has not yet released the standard’s companion compliance directive and their interim enforcement guidance is incomplete. AGC believes that this could result in inconsistent enforcement across regions. If your members have been subjected to an OSHA silica compliance inspection or silica compliance was assessed as part of another OSHA inspection, please encourage them to share the details of the inspection(s) with AGC by completing the form. AGC will report the findings to OSHA’s national office and use it to continue our advocacy efforts on behalf of the regulated community.

Rachel Reim has become the new Eastern Region District Manager for the AGCVA.  She will be responsible for the Tidewater and Peninsula districts activities and membership recruitment.  Rachel is a Michigan native and graduated with her Bachelors of Arts from Grand Valley State University in Hospitality Tourism Management, specializing in Meeting Planning. She resides in Virginia Beach with her Family, her husband Benjamin who is a Civil Engineer, their 1-year old daughter, Hannah and yellow lab, Frank. 


She began employment on October 16, 2017 and has jumped in by working on several workforce development solutions with local school districts and community colleges and has been learning the ropes from Dick Moyers who will be retiring this month.  Welcome Rachel!

Richard “Dick” Moyers will be retiring from AGCVA on December 4, 2017.  Dick has been with AGCVA since 1998 as the Executive Director and Eastern Regional Manager.  He has been an effective District Manager with many Sold Out Events in his districts. 


Dick has been a leader with a “get it done” attitude that has served the Districts well.  Through his leadership, the Districts have helped members grow their business, help their communities, and learn the meaning of teamwork!


He moved his family from the Shenandoah Valley with experience as the Executive Director of the Virginia Poultry Federation.   He graduated with a Masters from James Madison University. We wish him well on his retirement and he will be missed.

VOSH and UVA-FM are partnering to offer a free OSHA 10 hr Construction in both Spanish and English. The courses will be held at UVA (Charlottesville), at the Zehmer Hall and it will take place over two days on February 22-23. No matter type of business you conduct at your workplace, fire safety should always be a main concern. Here are a few fire safety tips you can distribute to your staff.

Fire Prevention
• Keep your work area free of waste paper, trash and other items that can easily catch fire.
• Check on your electrical cords. If a cord is damaged in any way, replace it. Try not to lay cords in  places where they can be stepped on, as this will contribute to deterioration of the protective outside coating.
• Don't overload your circuits.
• Turn off electrical appliances at the end of each day.
• Keep heat producing equipment away from anything that might burn. This includes copiers, coffee makers, computers, etc.
  
In the Event of a Fire
• Upon finding a fire, call 911 immediately and don't hand up with the emergency responder until told to do so.
• Close doors when exiting to help limit the spread of smoke and fire throughout the building.
• Never use elevators during an evacuation.
• Follow the escape plan and meet at a per-determined place outside of your building and away from danger. Conduct a headcount to ensure all of your staff has evacuated.
