The U.S. continues to experience labor shortages across many industries and roles. This increasingly hurts business owners, as attracting and training new employees can be more costly than implementing an employee retention strategy.

According to the National Association of Insurance Commissioners, 71% of small businesses reported that they were dependent on one or two key individuals for ensuring organizational success.

Question: One of our employees is constantly disregarding safety instructions. He recently injured himself at work and filed a workers’ compensation claim. This is the third time in the past two years this has happened, and it will probably continue because he doesn’t follow safety rules. Are we allowed to discipline him when workers’ compensation is involved? I don’t want to keep having these claims when it’s his own fault for not following directions.

Legislative Updates
Early voting for the March 5th primary election is underway as of Tuesday, February 20th. There will be a minimum of 15 new House members and two new senators in the legislature next year based on voluntary retirements with more expected following election outcomes in March and November.

All is quiet in Austin while legislators are mostly busy in their districts working on their re-election efforts and tending to their personal professions. However, following the election, we expect the lieutenant governor and speaker to issue interim charges to their standing committees. We will monitor the charges for potential impact on PHCC members and their interests. Meanwhile, the securities fraud trial for Attorney General Ken Paxton is set to commence April 15th in Harris County. General Paxton has plead not guilty to the charges stemming from a 2015 indictment. This is a separate issue from the Paxton impeachment trial last fall when he was acquitted of sixteen articles of impeachment.
Chuck White and Mark Valentini of National PHCC’s government relations team provided their annual review of 2023 and a 2024 outlook of legislative and regulatory trends impacting p-h-c contractors. Fuel choice and gas ban policies at the federal and state level continue to be the top priority for National PHCC, with the rise in gas ban policies at the state and local level potentially shifting the market toward heat pump appliances.
