Greater transparency in third-party litigation funding and direct appeals to congressional leaders to curb foreign-backed lawsuits top the 2026 legislative agenda of the Risk & Insurance Management Society. The organization will press lawmakers on these issues during its Legislative Summit scheduled for March 18-19 in Washington. RIMS will also advocate for reauthorization of the Terrorism Risk Insurance Act, set to expire in December 2027, and a long-term National Flood Insurance Program.

In 2025, there were 23 weather and climate disasters in the U.S. with at least $1 billion in damages. According to the U.S. Chamber of Commerce, every dollar not spent on resilience before a disaster can cost communities up to $33 in lost future economic activity. The National Institute of Building Sciences reports adopting the latest building code saves $11 per $1 invested.

A group of U.S. Senate Republicans introduced legislation to force greater disclosure of third-party financing for mass torts and class action lawsuits. The bill, spearheaded by Senate Judiciary Committee Chair Chuck Grassley, would exclude nonprofit legal organizations from disclosure requirements if funds came from U.S.-based donors to provide pro bono representation. The legislation would also bar third-party funders from influencing litigation strategy or settlement talks.

The U.S. Supreme Court ruled 6-3 that President Donald Trump's use of the International Emergency Economic Powers Act for Liberation Day tariffs and fentanyl-related duties on Canada, Mexico and China was not legal. Chief Justice John Roberts wrote that the Constitution clearly gives Congress power over taxes and tariffs. The decision does not affect Trump's use of other tools to impose duties on Canadian steel, aluminum, automobiles and lumber.

The U.S. Bureau of Labor Statistics reports that roughly 400,000 insurance professionals are expected to exit the industry by 2026, many from specialized, business-critical roles. Gen Z and Gen Y will grow from 45% of the workforce today to 75% by 2030, changing expectations about flexibility, purpose and career pathways.

Investments in global insurtech rose 19.5% during 2025 to $5.08 billion from $4.25 billion in FY 2024, marking the first annual increase since 2021, according to Gallagher Re's Q4 Global Insurtech Report. Re/insurers made more private technology investments into insurtechs — 162 deals — than any other year on record, with two-thirds of funding going to AI-centered insurtechs.
