Stricter New Rules Limit Independent Contractor Hiring

A new independent contractor rule from the U.S. Department of Labor (DOL) could spark an increase in misclassification lawsuits and make businesses less likely to hire gig workers, experts say. The final rule restores a previous multifactor standard that required companies to weigh a variety of economic factors together to determine whether a worker is an employee or an independent contractor. It took effect March 11.

CRA Needs Your Input on the Possibility of Developing Cyber Insurance Policy

To CRA Members:

Data breaches, malware and distributed denial-of-service attacks are all becoming increasingly
worrisome threats for the rental industry. Cyber insurance is one option that can help protect your business against losses resulting from a cyber attack. The CRA is exploring a Master Insurance Policy for the members that will provide coverage in four critical areas:

1. Data Breaches: Cyber insurance can offer coverage for data breaches, including the costs of litigation, recovery and identity theft.

2. Reimbursement for Business Loss: An effective cyber insurance policy will insulate a company from these costs and provide reimbursement for any income that was lost due to a cyber attack.

3. Defense Against Cyber Extortion: Ransomware works by disabling the target’s computer or device and demanding payment to regain access. Cyber insurance offers an effective defense against these types of attacks, though, by allowing businesses to recoup the costs associated with cyber extortion.

4. Forensic Investigative Support: It’s imperative a business rectify the problem and implement preventive strategies, so it does not happen again. A cyber insurance policy will reimburse costs associated with a forensic investigation of the attack.

A Master Cyber Policy will provide the CRA Members with broad coverage at an affordable rate.

AI Is Coming to Construction: Are You Ready?

Contractor Josey Parks told several thousand attendees at a recent tradeshow in Las Vegas that they need to embrace artificial intelligence; otherwise, they could find themselves out of business.

“AI for good will make our lives so much better,” said Parks during his keynote presentation on artificial Intelligence. “We need to accept it and move forward.”

But contractors don’t need to become coders. “You just need to open your mind to what’s coming and how to prepare your business.”

“AI and machine learning are advancing rapidly,” he said. “Adoption will continue despite skepticism.” AI offers opportunities for businesses to improve efficiency, insights and decision making. And although they may not know it, roofing companies use AI in the form of automated scheduling, damage detection and predictive analytics, Parks said.

“Think of ways to use it in your business,” he added. “With all the changes that are coming, you have to figure out how to use it.”

The Center for Jobs and the Economy has released a special report that responds to WalletHub's assertion that California ranks low in state tax rates. The reality is clear: California is a high tax state, as demonstrated by its consistently high contribution to total state taxes and its ranking as the highest state tax state in both 2021 and 2022. For additional information and data about the California economy visit www.centerforjobs.org/ca.
California is a High Tax State. The extent to which this statement is true is often obfuscated by the approach taken in different comparisons that look at tax rates or only a select number of the many different taxes the state has chosen to impose. The results, however, are not so murky. At least part of the reason the state now lags on job creation, especially private job creation, is the degree to which state and local taxes divert employer resources away from investment, wages, and jobs, and as employees face higher costs both through the taxes they pay directly as well as business taxes passed on through prices to the ultimate payers.

California Sued, Again, Over Advanced Clean Fleets Rule

Former U.S. Attorney General’s group suing California over emissions rule.

A group whose legal arm is led by former U.S. Attorney General William Barr is suing California over its Advanced Clean Fleets regulation requiring fleets to transition to zero-emissions trucks, beginning this year in the drayage sector.

The American Free Enterprise Chamber of Commerce (AmFree Chamber), whose Center for Legal Action is chaired by Barr, and Associated Equipment Distributors (AED) filed the lawsuit on April 1. The ACF rule is also under fire from the California Trucking Association, which filed suit in October.

“The ability to move people and products reliably and affordably is foundational to free enterprise and a functioning marketplace that serves American consumers,” said Gentry Collins, AmFree Chamber CEO. “The attempt currently underway by the state of California to ban liquid fuels and internal combustion engines is a major threat to the American way of life and terrible climate policy to boot.”

AmFree Chamber called the mandate “a power grab that seeks to regulate out-of-state truck fleets if they so much as cross the state line even once per year.”

Workplace Shootings Not Always Compensable

While gunshot wounds or deaths are not common workplace injuries, they have become more frequent in the past few years. According to an article in TIME, among companies with employer-sponsored health insurance, the rate of total firearm injuries in employees and dependents increased more than fourfold from 2007 to 2020—from 2.6 to 11.7 per 100,000 insurance enrollees. However, the circumstances surrounding a gun-shot injury or death at a worksite are not always clear and may have surprising outcomes depending on the jurisdiction. In 2023 several such cases were notable.

CARB’s Zero Emission Forklift Regulation will cost local communities, small businesses, nonprofits, and government agencies $27 billion

The Western Propane Gas Association (WPGA) recently released an economic impact report (https://westernpga.org/resources/forklift-regulation-resources/) that found that the California Air Resources Board’s (CARB) regulation to eliminate internal combustion engine (ICE) forklifts will cost California forklift owners and operators up to $27 billion. This includes increased costs and direct impacts to local communities, small businesses, food banks and nonprofits, state agencies and local governments, throughout the state at a time of a large state budget deficit. While some costs and impacts can be anticipated with the passage of this rule, there are unintended consequences that have not been accounted for that would have a rippling economic effect across the state.

California Trade Report for January 2024

Trade levels in general showed improvement as the California ports continued to recover some of the market share lost during the uncertainty generated during the extended labor negotiations. On a 12-month moving average basis, California’s share of total US goods trade rose for the sixth month in a row, but still remained below the pre-pandemic level and just under a quarter below the series high of 20.6%. In constant dollars, exports inched up compared to a year ago, but also were well below the pre-pandemic level. Imports, in contrast, passed the pre-pandemic mark.

A bold idea for California: Instead of passing so many new laws, how about some oversight over existing ones?

Jon Coupal, president of the Howard Jarvis Taxpayers Association, offers the following in a recent article:

The reaction from politicians to California’s budget deficit – now estimated by the Legislative Analyst to be around $73 billion – breaks down into two camps: the state must either reduce spending or find more revenue. (Euphemism for raising taxes.)

In reality, even the most progressive legislators realize that their dream of unending growth in government is crashing headlong into reality. However, to the tax spenders, all government spending is “essential,” notwithstanding the fact that state spending has doubled in six years.
Ordinary Californians reject the premise that all state spending is “essential” and, in fact, think much of it is superfluous and wasteful. A Public Policy Institute of California survey showed that, overall, 45% of Californians perceived that “a lot” of their money was being wasted and 46% believed “some” of their money was wasted.
When it creates a new program, the Legislature frequently requires the affected state or local agencies to prepare a report back to the Legislature about the performance of the new program. The purpose, according to the Legislature itself, is to “provide crucial oversight to ensure effective implementation of programs.” But according to an article in CalMatters (“Legislators wanted 1,100 reports on how California’s laws are working. Most haven’t arrived.”) more than 70% of the 1,118 reports due in the past year were not submitted to the Office of Legislative Counsel, the public repository for the reports... and about half of those that were filed were late. (About 230 were reports required from multiple agencies.)
The absence of reports on the efficacy of past legislation makes future legislation like a journey into the unknown. CalMatters correctly contends that the “reports could be used to avoid introducing duplicative or unnecessary bills.” But a more fundamental purpose would be to determine which laws or programs should simply be repealed or abandoned entirely.
Scrutiny of whether existing programs are performing as intended should be high on the list of ways to get more bang for each taxpayer buck. Especially when California is $73 billion in the hole.

Don’t blame Prop. 13 for California’s mental health crisis

The tax-and-spend lobby loves to blame Proposition 13 for all of California’s woes. This has become so routine that we at the Howard Jarvis Taxpayers Association have compiled a “Top 10” list of things for which Proposition 13 is alleged to be responsible. Keep in mind that these are more than just general complaints that “Prop 13 prevents unlimited taxes on property.” We gladly accept the blame for that one. But most of the attacks lack foundation and many are just flat out laughable.
Because mental health and the associated homelessness is now the “crisis de jour” in California, it only stands to reason that Prop 13 would be blamed for that as well. In an otherwise objective CalMatters piece by Jocelyn Wiener, she contends that the “California tax revolt [led] to austerity,” and that Prop 13 “reduced the amount of money available to counties for a variety of services, including mental health.”
But any reduction in mental health services was far more a result of lack of prioritizing important programs. Moreover, the state itself – possessing an “obscene surplus” according to Jesse Unruh – immediately backfilled local government coffers. Finally, any alleged “austerity” disappeared quickly because, in the wake of Prop 13’s passage, explosive economic growth created billions in new tax revenue.

Is California Ready for Full Electrification?

The American Transportation Research Institute (ATRI) has been conducting research on the challenges of electrification to provide data on what it will take to transition to electric vehicles. IRS Tax Tips: Businesses Can File Form 1099 Series Information Returns for Free

Business taxpayers can file electronically any Form 1099 series information returns for free with the IRS Information Returns Intake System (IRIS). IRIS accepts 1099 series forms for tax year 2022 and after. IRIS is available to any business of any size. It’s secure and accurate and it requires no special software. It also reduces the need for paper forms. Starting in tax year 2023, businesses with a combination of 10 or more information returns must file them electronically.

California Trade Report for November 2023

Here are highlights from the recently released trade data from the US Census Bureau and US Bureau of Economic Analysis. Compared to a year ago, the November trade numbers in general show improved activity through the state’s ports. Both origin exports and destination imports were up in nominal terms. Although down sharply from the prior month surge, total trade activity through the state’s ports was also up (6.3%) in nominal terms compared to the prior year, producing continued improvement (on a 12-month moving average) in both the share of US trade through the state’s ports and the state’s share of total US origin exports. This improvement comes as port activity recovers from the uncertainty facing shippers during the prolonged labor negotiations, and as global trade patterns face disruption from the Panama drought and threats to ships transiting through the Suez Canal. In nominal terms, total trade through the state’s ports year-to-date remained down from the 2022 highs, but also remained above the pre-pandemic levels in 2019.

QUICK FACTS: California Employment Report for November 2023

The Center for Jobs and the Economy has released their initial analysis of the November Employment Report from the California Employment Development Department.
November Data Again Posts Mixed Results. Nonfarm jobs showed a gain in November, although coming in at a more restrained 9,300 and the October gains revised down by 5,700 to a still respectable 34,500. Information gained as Motion Picture related jobs returned to pre-strike levels. Tech jobs also reported some gains, counterbalancing the continuing series of layoff announcements coming from this industry. While both showed growth in the unadjusted data, Transportation, Warehousing & Utilities reported only a modest increase in the adjusted series reflecting the general slowdown in trade activity compared to previous years’ seasonal bumps, and Retail Trade posted a loss in the adjusted data that reflects the substantial shift to online sales. Job gains, however, were dominated by the lower wage end, in particular continued expansion of government-paid very low wage jobs in Individual & Family Services.

Employment—the number of people working—dropped again for the 5th month in a row, showing a loss of 35,400 for the month and a total drop of 147,700 for the five-month period. Combined with a growing number of unemployed, weakness in the labor force has now essentially eliminated the previous labor shortage conditions that had throttled down the state’s job expansion potential. Labor supply (number of employed and unemployed) has now fallen below labor demand (employed plus job openings), reversing the conditions previously favorable to stronger wage growth to a situation where increasing unemployment becomes more likely.

OPINION:�Colorado’s Lesson to California about Tax Reform

Jon Coupal, president of the Howard Jarvis Taxpayers Association, recently commented on a lesson he believes California can learn from Colorado...

Can meaningful tax reform advance, or even survive, in progressive blue states? In California, this is not just an academic question. Proposition 13 has been under constant assault since its passage in 1978. But the core of Proposition 13 – the one percent tax rate cap on real property and the two percent limit on annual increases in taxable value – remains unscathed.

Prop 13’s popularity over four decades has remained constant even as the California of Ronald Reagan and Pete Wilson has morphed into one of America’s most liberal states. Now, two-thirds of both houses of the California Legislature are held by Democrats, as well as all statewide elected offices. And yet polling suggests that if Prop 13 were on the ballot today, it would still pass by more than 60% just as it did in 1978. (Prop 13 even survived an effort to strip its protections from “evil” corporations when voters rejected the “split roll” initiative in 2020).

Don Cruikshank Obituary

We are deeply saddened to share the news of the passing of former CRA Board of Director member, Don Cruikshank, on November 24, 2023. Don ran a successful equipment and event rental business, a legacy continued by his children, who also work in the field. Don moved to the area as a 4-year-old in 1957, and attended elementary school in Newhall before going off to Alemany High. He studied to become an emergency medical technician at College of the Canyons before working as a paramedic for about eight years. Cruikshank and his business partner Mike Redmond purchased a business that they turned into AV Equipment Rentals in 1978. Don steadily gained a reputation as not only a sound businessman, but also one who gave back, according to those who knew him.

Finding Alternatives to Opioids: Virtual Physical Therapy

The opioid epidemic continues to ravage communities across America, taking over 41 lives per day. In the workplace that means billions in lost productivity and increased healthcare expenses. In their quest for solutions to keep their workforce safe and productive, employers are trying out an innovative new approach, virtual physical therapy.

The Dangers of Opioids. The impact of widespread opioid addiction and abuse is being felt across all industries. Approximately three-quarters of employers report their workforce has been affected in some capacity, whether through side effects like fatigue and confusion or more severe dependence and addiction issues. However, most organizations feel unprepared to properly address this growing crisis.

The trouble frequently begins with prescription painkillers for acute injuries or recovery. While intended only for short-term use, these highly addictive medications can trap patients in a dangerous cycle of dependence, especially those who have chronic musculoskeletal disorders, which affect half of Americans.

Portable Equipment Registration Program (PERP) Phase Out Date and Modification Deadline for Tier 3 Engines Owned by Large Fleets

A reminder from the California Air Resources Board about the Portable Equipment Registration Program (PERP) Phase Out Date and Modification Deadline for Tier 3 Engines Owned by Large Fleets:
December 31, 2024 is the phase out date for Tier 3 portable diesel engines owned by large fleets and built prior to 2009 rated 50 brake horsepower (bhp) to 750 bhp. Large fleets were established on June 30, 2019, and have a total cumulative horsepower over 750 bhp for all portable engines under common ownership and control of the fleet.

These engines, whether registered in PERP, locally permitted, or otherwise subject to the Portable Diesel Engine Airborne Toxic Control Measure, will no longer be able to operate in California after December 31, 2024.

The engine tier and phase out dates are listed on each applicable PERP registration certificate. To continue operation past the phase-out date, you must submit a modification request using PERP Form 20.

Business Roundtable Responds to Governor's Announcement on Retail Theft

California Business Roundtable President Rob Lapsley issued the following response to Governor Newsom's recent announcement on retail theft this holiday season:
“While today’s announcement is welcome news for retail establishments across the state, it continues to be a piecemeal response to a broad and complex problem that directly impacts an important part of our state revenue and services. From cargo theft, to retail theft, to porch pirates, the issue is much broader and
requires a much more aggressive solution.
"While we are disappointed that the proposed initiative solution is not on the streets collecting signatures for the November 2024 ballot, it is the responsibility of the Legislature to fix the problem. We look to the new
leadership of Assembly Public Safety Committee Chair Kevin McCarty and Speaker Robert Rivas to work
with the statewide business community and law enforcement leaders such as Sheriff Jim Cooper on
immediate and comprehensive solutions, including the critically needed fixes to Prop. 47 that our research
shows will be strongly embraced by voters throughout California."

(Prop 47 was a ballot measure passed by California voters on November 5, 2014. The law made some non-violent property crimes, where the value does not exceed $950, into misdemeanors. It also made some simple drug possession offenses into misdemeanors. It also provides that past convictions for these charges may be reduced to a misdemeanor by a court.)

California Energy Price Data November 2023

The California Center for Jobs & the Economy reported on the monthly updates from the most current November 2023 fuel price data (GasBuddy.com) and September 2023 electricity and natural gas price data (US Energy Information Administration).

Overall, California’s energy price rankings were unchanged, remaining at or near the highest among the contiguous states. Average commercial electricity, gasoline and diesel prices were again the highest, and industrial electricity the second highest. 4.8% CA Unemployment Rate: California's reported unemployment rate (seasonally adjusted) in October was up 0.1 point to 4.8% as employment continued to lose ground. The US rate was also up 0.1 point to 3.9%. California again had the 3rd highest unemployment rate, ahead of only Nevada and DC.

-28.8k CA Employment: Employment dropped 28,800 (seasonally adjusted). In the last 4 months, total employment dropped 112,200. US employment was down 348,000. California unemployment rose 17,700, while US unemployment rose 146,000.

62.3% CA Labor Force Participation Rate: California labor force (seasonally adjusted) was down 11,100, while the labor force participation rate remained level at 62.3%. The US labor force
was down 201,000, while the participation rate dipped 0.1 point to 62.7%.

Cole Schlitzer Promoted to Assistant Rental Division Manager

Mi-T-M Corporation recently announced the promotion of Cole Schlitzer to Assistant Rental Division Manager. Schlitzer joined Mi-T-M in 2017 as a Customer Service Representative and quickly worked his way to his most recent role, Territory Account Sales Representative. Workers Comp Basics: The Four Types of Disability Benefits

In determining the extent of a worker’s injury, doctors evaluate the degree of disability or impairment. The injury may be permanent or temporary. When an employee is injured and cannot work, disability benefits replace a portion of the employee’s lost wages. They are usually calculated based on the worker’s average weekly wage before the injury. There is usually a waiting period before payments begin, and there are usually minimum and maximum payment thresholds. Benefits may also vary widely by state.

California Energy Price Data September 2023

The California Center for Jobs & the Economy reported on California's energy price data from September... Fuel prices rose higher in California as crude prices flirted with the $95 a barrel level in September combined with supply issues related to refinery maintenance and interruptions caused by Tropical Storm Hilary. The average gasoline price rose 51 cents a gallon in California while dipping 4 cents in the rest of the US. In the most recent data from CSAA, the California average on October 5 was up another 19 cents, while the overall US average dropped 7 cents.

Prices are likely to trend lower over the coming months. In spite of OPEC+ efforts to manage supply, crude prices to date in October are down sharply in response to concerns over softening demand as global economic conditions remain uncertain and as the prospects of another Fed rate hike remain on the table. The governor also recently issued directions to the Air Resources Board to allow an early shift to the cheaper winter blend formulation in yet another tacit acknowledgement of the extent to which California’s own rules contribute heavily to price volatility. While a similar action in 2022 helped lead to a large drop in wholesale prices, it is not yet clear on the extent to which the market now has come to expect this type of action and already prices in regulatory easing in response to consumer anger.

As we have tracked, gasoline is not the only energy source for which California prices rank the highest or near the highest as state regulations, taxes, and fees have continued to push prices ever higher.

California Trade Report for September 2023

The California Center for Jobs & the Economy recently released trade data from the US Census Bureau and US Bureau of Economic Analysis concerning California's Trade Report for September 2023. Overall trade levels were off compared to September 2022, although California’s total share of trade through US ports saw a pause in its decline (on a 12-month moving basis) for the first time since March 2021. In nominal terms, origin exports edged down 3.3% from last September, destination imports were off 4.3%, and total trade through the state’s ports were only marginally lower at 0.7%. Compared to the pre-pandemic levels, however, all activity levels were higher.

California Puts Teeth in Emission Regs with New ‘Smog Check’ System – Owners Operating There Must Register

The Commercia Carrier Journal reported that owner-operators and fleet owners who operate in California can now register their vehicles in a new California Air Resources Board system before the state implements a new “smog check” requirements on most trucks twice a year.

The new Clean Truck Check program was approved by CARB in December 2021 to replace the state's current Periodic Smoke Inspection Program (PSIP), from which most independent owner-operators were exempt.

Clean Truck Check requires non-gasoline (diesel, alternative fuel, and hybrid) trucks, buses, and other heavy-duty vehicles (such as California-registered motorhomes) with a gross vehicle weight rating over 14,000 pounds to undergo emissions testing if they operate in California. Clean Truck Check applies to most large vehicles that operate in California, regardless of the state in which they're plated. The purpose of the program is to ensure all emissions-related equipment is functioning properly for the life of the vehicle.

Taxpayers Respond to Newsom’s Anti-Prop. 13 Lawsuit

In September, this column reported on the lawsuit against taxpayer and business groups brought by Gov. Gavin Newsom and the California Legislature seeking to have the Taxpayer Protection and Government Accountability Act (TPA) removed from the November 2024 ballot.
The purpose of TPA is to restore key provisions of Prop 13 and other voter-approved ballot measures that gave taxpayers, not politicians, more say over when and how new tax revenue is raised. TPA is necessary because, over the past decade, the California courts have created massive loopholes and confusion in long-established tax law and policy. TPA closes those loopholes and provides new safeguards to increase accountability and transparency over how politicians spend our tax dollars. It is the only long term check and balance on a permanent two thirds supermajority progressive Legislature.
The reaction of California’s tax-and-spend progressives to the qualification of TPA is, as one would expect, shrill and hyperbolic. A massive misinformation campaign by the League of California Cities predicts that the passage of TPA would be an “end times” event. Of course, the League predicted the same thing in 1978 over Prop 13.

NFIB – CA Victories During 2023 Legislative Session!

The 2023 California legislative session has officially concluded and the National Federation of Independent Business (NFIB) was able to defeat or successfully persuade Governor Newsom to veto several key bills that would have created new burdens and costs for small business. With the help of members like you taking action and our advocacy efforts at the State Capitol, NFIB defeated the following bills:

Senate Bill 799 (Portantino): Would have expanded unemployment benefits to striking workers. NFIB small business members would have seen their payroll taxes increase to fund unemployment payments to individuals who are not unemployed but deliberately participating in a work stoppage. California’s Unemployment Insurance Trust Fund is currently $18.5 billion in debt to the federal government. Adding eligibility benefits to workers who do not meet the federal standard as defined would have been fiscally reckless and further jeopardized the solvency of California’s UI Trust Fund. It is also estimated that the state’s Economic Development Department paid out an estimated $30 billion in fraudulent unemployment claims during the pandemic. Governor Newsom vetoed SB 799.

Assembly Bill 524 (Wicks): Sought to label “family caregiver” as a new protected class. A "family caregiver" could essentially be anyone the employee deems to be a "family member" regardless of whether or not the individual being cared for is actually a family member or not. This legislation would have increased actual and administrative costs for the state’s paid family leave program and exposed small business owners to new liability and punitive actions. Governor Newsom vetoed AB 524.

Assembly Bill 518 (Wicks): Would have expanded eligibility for benefits under the paid family leave program to include individuals who take time off work to care for a seriously ill individual related by blood or whose association with the employee is the “equivalent of a family relationship”. This vague and undefined term would have drastically increased paid family utilization and system costs. NFIB opposed this legislation, and it stalled in committee prior to the end of 2023’s session.

Special Report: Was California the 4th Largest Economy in the World in 2022?

The Center for Jobs and the Economy has released a special report that delves into a critical question: "Was California the 4th Largest Economy in the World in 2022?" This comprehensive report provides insights into California's economic position, particularly in terms of its global ranking.
Did We Make It? Nope. Although we did close the gap a little—with California’s economy going from 79% as large as Germany’s in 2021, to 88% as large in 2022—the current projections suggest this is as far as California will go relatively speaking and likely no further at least within the immediate horizon.
In October last year, a Bloomberg opinion piece set the state’s political world abuzz over the prospect of being the 4th largest economy in the world. Putting aside the notion that this conclusion came from conjecture rather than facts or even a formal projection, the state’s leaders quickly took up the claim that California was now Number 4. The Bureau of Economic Analysis release last week of state GDP data for 2022 and the more recent update of the international GDP numbers by the International Monetary Fund (IMF) indicate, however, that this claim was at best premature.

The 2023 Pre-Golf Tournament Yard Party and the Golf Tournament

CRA's Pre-Golf tournament Yard Party at MTA was a great start to the Golf Tournament, which benefits the Rental Industry Services Foundation (RSIF). MTA has a beautiful warehouse with which it services the greater Southern CA area and the West Coast with ease. MTA has much to be proud of.

Attendees enjoyed excavator golf, sponsored by VCES Volvo, and CYRP sponsored a virtual golf pro to assist with players' golf swings and games. Vendors were on hand to discuss their equipment and new release items. The event closed with a delicious BBQ dinner and goodies.

The golf tournament started off on Friday, November 3, 2023, with a beautiful day. The weather cooperated but did get to borderline hot. With close to 90 golfers, the shotgun start began promptly at 11 am. Competition was fierce for 1st, 2nd, and 3rd place winners and closest to the hole winners for both men and women. As golfers completed their rounds, smoked, old-fashioned cocktails could be taste-tested with hand-rolled cigars. Robert Pederson of A Tool Shed and Jeff Roberts of City Rentals conducted a blind taste test of their favorite whiskey. Each whiskey was brown bagged and a vote was taken. Robert's TX Whiskey beat out Jeff's Pendleton Whiskey. You be the judge, but I would say a good time was had by all.

Dave Thiesse Named Mi-T-M Vice President of Commercialization

California Trade Report for August 2023

The Center for Jobs and the Economy reports on the highlights from the recently released trade data from the US Census Bureau and US Bureau of Economic Analysis. To view additional data and analysis related to the California economy visit www.centerforjobs.org/ca.

With the West Coast labor situation resolved, the ports can now turn their attention to regaining lost traffic and the associated blue collar and related jobs that rely on this activity. Unfortunately, moving beyond this point also means the ports must now focus on other threats to this core jobs base, including the continued rise in operating costs especially energy and new regulatory threats that would place a cap on allowable port activity in the state.

The August trade results show a weakening in trade activity, reflecting both the challenges to trade in the state along with overall softening in the global trade numbers. In nominal terms, origin exports were down 6.2% from August 2022, destination imports down 10.7%, and overall trade through the state’s ports off 7.8%. Year-to-date, however, total trade through the state’s ports has been somewhat higher than the pre-pandemic years, although lower than the same period in 2022.

The California Air Resources Board (CARB) has established an effective date of December 31, 2023, for California Code of Regulations, title 13, sections 2196.1, subdivision (f), 2196.8, 2197, and 2197.2, subdivision (b), within the Heavy-Duty Inspection and Maintenance Regulation.

The Heavy-Duty Inspection and Maintenance (HD I/M) regulation subjects nearly all nongasoline vehicles with a gross vehicle weight rating over 14,000 pounds that operate in California to periodic emissions testing. These testing requirements help ensure that heavy-duty vehicles operating in California remain equipped with properly functioning emissions controls, and when malfunctioning, that these systems get repaired in a timely manner. Through the repair of malfunctioning emissions control systems, the HD I/M regulation will substantially reduce toxic particulate matter and emissions of oxides of nitrogen from the heavy-duty vehicle sector. This will help reduce air pollution and improve public health across the state, especially in communities disproportionally impacted by heavy-duty vehicle activity.

The Fight for Proposition 13 Heads to the Ballot

Jon Coupal, president of the Howard Javis Taxpayers Association, recently offered this commentary on Prop. 13: Last week, and despite the popularity of Proposition 13, the California Legislature passed two proposed amendments to the California Constitution that rip huge holes in that iconic taxpayer protection overwhelmingly approved by voters in 1978. But here’s the good news. These anti-homeowner bills must be approved at a statewide election and, given the anger from thousands of constituents who flooded the Capitol with calls, letters, and petitions, the two measures are likely headed for the defeat they so richly deserve.

Competitions, games and vendor displays will be along the course at Eagle Glenn Golf Course for the enjoyment of the golfers. A reception follows with awards and a raffle. The cigar bar is back with a Whiskey & Bourbon tasting!

Pauley Equipment Co. has an amazing history, with roots dating back to the early 1980s. Founded by the Pauley family, the company grew to three locations in Riverside and San Diego counties through will, determination, hard work, and friendly service. How Does Self-Insured Workers Compensation Work?

According to Statista, a global data and business intelligence platform, the percentage of employees covered by self-funded workers compensation plans increased from 44% in 1999 to a record high of 67% in 2020. Two years later, during the height of the pandemic, that figure had decreased slightly to 65% in 2022, but the trend for employers to self-insure is still on the rise.

Most companies purchase workers compensation coverage from traditional providers, either through a private insurance company or from a state-owned insurance company. You pay your premiums, and your insurer takes care of handling and paying all claims, and it bears all financial risk. Self-insurance is an alternative that has become increasingly popular among larger employers.

Minimum Wage Increases Lead to Economic Uncertainty: A Case Study of the Proposed City of Los Angeles Minimum Wage Increase

The Center for Jobs and the Economy is a nonprofit research organization that provides economic data and detailed analyses of policies affecting state, regional and local economies. As part of its mission, the Center helps quantify the cost-of-living crisis in the state and various regions. This report examines the overall effect of the proposed $30/hour minimum wage for travel and tourism industry workers currently being debated by the Los Angeles City Council.

While there has been extensive economic analysis of the impact of minimum wage increases, this report seeks to quantify the overall impact to the family budget, not just focused on the wage increase, but what that wage increase means in the context of overall household income. As demonstrated in this report, the full effects of the proposed wage increase can vary widely depending on individual household circumstances after taking into account factors such as increased tax liability, reduction of social program support and other income-based benefits, and whether workers retain their jobs and hours.

California Trade Report for July 2023

According to a report by the California Center for Jobs and the Economy, in July, the trade numbers for California showed the combined effect of the extended labor negotiations along with declining economic activity in China. In nominal terms, origin exports were down 8.6% compared to the prior year, and destination imports down more sharply at 16.2%. Overall trade flows through the state’s ports were off 11.7%. In real terms, total trade through California ports has been down in every month so far this year compared to 2022 levels, and down in every month except March when compared to pre-pandemic 2019 Click on "Learn more" for highlights from the recently released trade data from the US Census Bureau and US Bureau of Economic Analysis.

California Employment Report for August 2023

The Center for Jobs and the Economy has released our initial analysis of the August Employment Report from the California Employment Development Department. For additional information and data about the California economy visit www.centerforjobs.org/ca.

Recovery Progress: California Numbers Show Substantial Weakening. Nonfarm jobs (seasonally adjusted) were up by 23,100, but July’s respectable gain of 27,900 was slashed to only 8,900 in the monthly revision. The preliminary benchmark revisions for March 2023 further indicate that the overall 2023 job numbers will likely be lower than previously reported to date. California showed the largest revision among the states, with the adjustment putting total nonfarm jobs 197,800 lower (-1.1%). This outcome indicates average jobs growth from April 2022 to March 2023 would plunge from 29,900 monthly to only 13,400. California’s adjustment also represents about two-thirds of the total preliminary revision (-306,000) to the national numbers. Both Texas (-15,000) and Florida (-9,700) showed much lower change.

The preliminary benchmark revisions are done only for March 2023 from the actual job counts from the Quarterly Census of Employment and Wages. The results will be broadened in the annual revisions to be released in March 2024 for the period 2019 through 2023.

The employment numbers were even more disappointing. Total employment (seasonally adjusted) dropped the second month in a row, down 27,900. The August number essentially reversed the 2023 gains, putting employment just below the June 2022 total.

Legislature Seeking to Destroy Prop 13! Oppose ACA 13�Stop Higher Property Taxes

The National Federation of Independent Businesses is urging California residents to oppose Assembly Constitution Amendment 13 (ACA 13), stating that labor unions are continuing their push to destroy Prop 13 and raise your small business property taxes. ACA 13, if passed, will raise the threshold of voters opposing tax increases from the current 50% plus one voter threshold to two-thirds of the voters. This will decimate Prop 13 and any other future measures aimed at tax relief and protection for Californians. Bad news for Main Street, bad news for seniors and families.
UPDATE: ACA 13 has advanced to the Senate floor and senators are set to vote on it. If ACA 13 is approved by the legislature, it will go to the voters for approval, as constitutional amendments approved by state lawmakers go directly to voters and do not need a signature from the governor.

Flip-flopping League of California Cities is Pushing Outright Lies to Get More of Your Money

In a California Commentary article of the San Gabriel Valley Tribune (Sept. 1), Jon Coupal explained his stance on the state's pending Assembly Constitutional Amendment 13.
One of the most closely watched – and hotly contested – pieces of legislation now pending in the Capitol is a direct attack on Proposition 13. Assembly Constitutional Amendment 13, until two weeks ago, was devoid of any substantive language. But it was subject to a “gut-and-amend” maneuver adding language that should alarm every California taxpayer.
To understand the severity of the threat posed by ACA 13 requires an understanding of how the courts weakened Prop. 13 over the last 45 years, especially by the infamous “Upland” decision in 2017, which opened the door to raising local taxes without the two-thirds vote that Prop. 13 requires. The court’s language in Upland led lower courts to allow local special taxes to pass with 50% plus one vote if proposed by a citizens’ initiative instead of a government body.

Coolant Leak the Cause of "Suspicious" Nikola Truck Fire, BEV Sales on Hold

According to an August article in the Commercial Carrier Journal, investigators have determined that an electric truck fire at Nikola headquarters June 23 once thought to be an act of foul play was due to a coolant leak inside a battery pack. The truck re-ignited exactly one month later. The findings by third-party investigation firm Exponent were further corroborated, Nikola said, "by a minor thermal incident that impacted one pack on an engineering validation truck parked at the company’s Coolidge, Arizona, plant on Aug. 10." No one was injured in either incident. Nikola said it is currently in the process of filing a voluntary recall with the National Highway Traffic Safety Administration (NHTSA) for approximately 209 Class 8 Tre battery-electric vehicles (BEVs), and is placing a temporary hold on new BEV sales until a resolution is in place. Nikola, in response to CCJ Monday, couldn't estimate how long this could take or how long BEV sales might be suspended.
