Changes to the Regulation 369 under the Farm Implements Act

The Ministry of Agriculture, Food and Rural Affairs amended Regulation 369, under the Farm Implements Act to reflect the harmonization of the Canadian Standards Association (CSA) and International Organization of Standardization (ISO) standards for Roll Over Protection Systems (ROPS) on agricultural machinery.  .

Section 11 under Regulation 369, outlines the responsibility of farm equipment dealers when selling tractors equipped with ROPS. The changes to the regulations are:

The inclusion of clause 4.4.1 of CSA B352.0-16 Rollover protective structures (ROPS), falling object protective structures (FOPS), operator protective structures (OPS), and tip-over protective structures (TOPS) for mobile machinery – General Canadian Requirements. That specific section  deals with seat and seatbelts requirements in newly manufactured tractors
The adoption of CSA B352.0-16 Roll-over protective structures (ROPS), falling object protective structures (FOPS), operator protective structures (OPS), and tip-over protective structures (TOPS) for mobile machinery – General Canadian Requirements, which harmonizes the general ROPS standards with various ISO standards

The adoption of CAN/CSA-M5700-09. Tractors for agriculture and forestry - Roll-over protective structures (ROPS) - Static test method and acceptance condition and CAN/CSA-M3463-09. Tractors for agriculture and forestry - Roll-over protective structures (ROPS) - Dynamic test method and acceptance conditions, which specifies the dynamic and static testing requirements for newly manufactured ROPS on tractors, respectively, and are harmonized with ISO standards

The inclusion of the CAN/CSA-M23205:12. Agricultural tractors - Instructional seat standard specifying instructional seat requirements for those installed in tractors. 

 The changes apply to tractors sold after July 1st, 2017 and, with the exception of instructional seats, tractors manufactured prior to the July 1st, 2017 are not required to meet the above changes.
