This Friday, the U.S. Supreme Court will hold a special session to hear arguments on whether a host of employer mandates related to COVID-19 should remain in place. One of these mandates is the Occupational Safety and Health Administration’s (OSHA) Emergency Temporary Standard (ETS). The ETS orders employers with 100 or more employees to require their employees to either get vaccinated against COVID-19 or be subject to weekly testing. The ETS, which had been stayed by the 5th Circuit Court of Appeals in November of last year, and then subsequently allowed to go into effect by the 6th Circuit Court of Appeals in December, now will have its fate determined by the highest court in the U.S. Absent the rule being vacated by the Supreme Court, OSHA will be allowed to implement and enforce the ETS. OSHA has stated that left unchecked, the new compliance deadlines are January 10 and February 9. Click here for more information on how the rule will impact ready mixed concrete operations, how to comply and to access NRMCA’s template written ETS policy. Click here to review the ETS language, FAQs, fact sheets and other OSHA materials. In light of the continued uncertainty of the ETS litigation, NRMCA continues to advocate on and monitor the ETS while updating the membership on its changing status. Members of the NRMCA Pave Ahead and Build With Strength teams recently exhibited at the International Council of Shopping Centers (ICSC) RECon 2021 in Las Vegas, NV. Senior Vice Presidents, Local Paving, Phil Kresge and Jon Hansen were joined at the exhibit booth by Senior Directors, Building Innovations, Patrick Matsche and Chris Dagosta. The annual convention had been cancelled in 2020 and was rescheduled from May to December 2021 due to the COVID-19 pandemic. NRMCA has had a presence at the show since 2015. “Though the overall size of the show was less than normal, the quality of the attendees and the opportunities they represent to our industry were still quite high,” says Kresge. The team obtained a number of leads which they will be following up on in the new year. ICSC is a global trade association with over 70,000 members in over 100 countries, including shopping center owners, developers, managers, marketing specialists, investors, retailers and brokers. For more information, contact Phil Kresge at pkresge@nrmca.org. From everything we read, 2022 will be another robust year for the industrial warehouse construction market, and with big warehouses come big outside paving opportunities. “During 2021, the largest percentage of reported success in the warehouse paving market segment came from NRMCA Parking Lot Boot Camp and ASCC contractors,” reports Jon Hansen, NRMCA Senior Vice President, Local Paving. “These contractors understand the approach to successfully and profitably build these multi-million square foot paving projects.” Now is the time to schedule your 2022 Parking Lot Boot Camp. Producer and contractor participation in Boot Camp is the most successful combination for winning projects. For more information, contact Jon Hansen at jhansen@nrmca.org or any member of the Pave Ahead team. Sen. Majority Leader Chuck Schumer (D-NY) has pledged to bring the Build Back Better Act up for a vote in the Senate despite opposition from Sen. Joe Manchin (D-WV). The legislation, as passed by the House of Representatives last year, proposes to spend some $1.75 trillion on social, health care and climate programs to deliver on part of President Joe Biden’s domestic agenda. In December, Sen. Manchin indicated he could not support the package in its current form and has engaged with the White House over proposed changes. On Tuesday, however, reports indicated that there were no ongoing discussions and that the Senate and White House were focusing on voting rights legislation. Most legislation requires 60 votes to be considered in the Senate. Because BBB is being considered under modified procedures known as reconciliation, it requires only 50 senators to vote to consider the legislation. With the Senate split 50-50, Majority Leader Schumer cannot afford to lose a Democratic vote, so if Sen. Manchin remains opposed, the BBB package cannot pass the Senate. NRMCA has joined the business community expressing opposition to tax increases and financial account reporting information included in the BBB package and will continue to oppose taxes and other policies that would negatively impact the ready mixed concrete industry.
