Supreme Court Blocks OSHA Vaccine Mandate, Allows CMS Mandate to Go Ahead

The Supreme Court has just ruled that the Occupational Safety and Health Administration (OSHA) vaccine mandate covering federal contractors and companies with more than 100 employees is not allowed to proceed. The mandate went into effect Monday, but companies will now not have to comply with this Emergency Temporary Standard (ETS.) If your company holds federal contracts or had 100 employees or more, then you do not have to comply with the OSHA vaccine mandate.

However, the court has allowed the Center for Medicare and Medicaid Services (CMS) ETS to proceed. The rule has new effective dates outlined below. This ruling was only on the staying of these rules, not on the merits of either case, so it is possible that either or both cases could come before the Court at a future date on the merits.
