NRLB Comments Filed by Coalition

NPMA joined over 90 members of the Coalition for a Democratic Workplace (CDW) last week in filing comments to a proposed regulation put forth by the National Labor Relations Board (NRLB). Under the proposal the Board would return to the traditional joint-employer standard under the National Labor Relations Act, ensuring that two or more entities can only be joint-employers over the same group of employees if they exercise direct and immediate control over the essential terms and conditions of employment for those employees. The proposal would therefore reverse the Obama-era Browning-Ferris Industries decision issued by the Board in 2015. In CDW’s comments the Board was urged to adopt the Proposed Rule but with additional clarifying definitions that would enhance predictability and stability of the rule’s application and outline essential terms and conditions of employment that allow for meaningful collective bargaining.
