EPA Delays WOTUS Rule Two Years

On Wednesday, January 31, U.S. Environmental Protection Agency (EPA) Administrator Scott Pruitt and U.S. Army Civil Works Acting Secretary Ryan Fisher signed a final rule delaying the implementation date of the 2015 Waters of the U.S. (WOTUS) rule. The rule follows a January Supreme Court decision concerning appropriate jurisdiction to litigate the legality of the 2015 rule. This decision could’ve allowed the 2015 definition of WOTUS to go into effect. Administrator Pruitt stated, “ EPA is taking this action to reduce confusion and provide certainty to America’s farmers and ranchers.” This amendment gives the agencies the time needed to reconsider the definition of WOTUS. NPMA will continue to work with EPA officials during the promulgation of a new WOTUS definition.
