NPMA Attends CDW Meeting to Discuss Labor Issues

Last week, NPMA attended a meeting of the Coalition for a Democratic Workplace (CDW), of which NPMA is a member. The CDW is composed of hundreds of organizations representing millions of businesses that employ tens of millions of workers nationwide in nearly every industry. CDW members are joined by their mutual concern over actions by the National Labor Relations Board (NLRB), which threaten entrepreneurs, other employers, employees and economic growth.  During the meeting the CDW discussed the December decision by the NLRB to overturn the onerous “joint-employer” standard decided in Browning-Ferris, by the NLRB, under the Obama Administration. This is a positive development by the NLRB under a Republican administration and a 3 – 2 Republican control. 

The Republican majority was unfortunately short-lived as NLRB Chairman Phil Miscimarra (R) was forced to step down under term limitations. The Trump administration is moving closer to replacing Miscimarra. Miscimarra was at the CDW meeting this week and provided valuable insight into recent decisions while he was still the NLRB Chairman, and also forecasted NLRB activity with a Republican majority.

CDW and NPMA, while pleased with the new direction of the NLRB, are still advocating for legislative fixes to the joint employer standard and will look for opportunities to move H.R. 3441, the “Save Local Businesses Act” in 2018.
