Court Rejects Chlorpyrifos Petition

A U.S. appeals court on Tuesday, July 18, denied a petition by Pesticide Action Network North America (PANNA), Earthjustice, and Natural Resources Defense Council to force the U.S. Environmental Protection Agency (EPA) to ban chlorpyrifos. The 9th Circuit Court of Appeals told the NGOs that they have to go through the agency process to challenge it before going to court, which is mandated by statute. EPA spokeswoman Amy Graham supported the Court’s decision stating, “This victory affords EPA the necessary time to conduct a proper evaluation under the law of the science and the studies on chlorpyrifos and provide clarity about the pesticide's safety to the American people.” It is reassuring to industry that the rule of law was upheld and that decisions on valuable products will be based on sound science.
