A coalition of small businesses has filed a lawsuit challenging President Trump’s authority to impose tariffs under the International Emergency Economic Powers Act (IEEPA), arguing that such actions exceed presidential powers and violate the Constitution’s separation of powers. The plaintiffs claim the tariffs have caused significant harm and assert that only Congress has the authority to set tax rates, including tariffs. This is the second recent legal challenge to the administration’s broad use of emergency powers for trade policy.
