Jurisdiction: 3rd Circuit
Date: Dec. 4, 2024
 
Holding: The court affirmed the dischargeability of a debt under 11 U.S.C. § 523(a)(2)(B), finding no clear error in the bankruptcy court’s determination that the creditor failed to prove the debtor intended to deceive her with materially false written statements regarding his financial condition.
 
Facts: The creditor allowed the debtor to use her credit cards for personal and business expenses based on his assurances of repayment and representations about his financial condition. After accumulating significant debt and failing to fully pay the balances, the creditor obtained state court judgments against the debtor, who subsequently filed for Chapter 7 bankruptcy. The creditor sought to except the debt from discharge, alleging that the debtor’s written statements about his financial condition were false and made with intent to deceive.
