Jurisdiction: Bankr. E.D. MO (en banc)
Date: March 29, 2024
In a case involving bifurcated Chapter 7 attorney's fees, the court found the language in the attorney-client agreement not to be clear and conspicuous, as required by Section 528(a)(1), because it was not clear that the firm would continue to represent the debtors if no post-petition agreement was signed. As such it was voided. However, the court held that the contracts were not so unclear as to be misrepresentation of services in violation of Section 526(a)(3)(A).
