The court reversed the bankruptcy court's imposition of sanctions on a debtor's attorney who certified that the debtors had completed their plan payments even though the debtors were delinquent in their direct monthly mortgage payments. Debtors' counsel argued that the law in the 9th Circuit was not settled concerning the issue of whether direct mortgage payments are "plan payments" under 11 U.S.C. § 1328.

The court denied the debtor's request for attorneys' fees from the United States Trustee under the Equal Access to Justice Act (EAJA) after the UST withdrew a motion to dismiss debtor's case.

• Share case law updates, bankruptcy news, and circuit announcements for the designated circuit through a weekly Circuit community post. • Develop custom content for discussions with fellow bankruptcy attorneys, as needed and at your discretion. • Provide community-related feedback to NACBA admin and the Circuit Communities Committee. • Recommend and implement engagement tactics, integrating the community into organizational programming, communication strategies, annual conferences, and events. • Seek and compile audience feedback to shape online circuit community management practices. • Lead Circuit Community Discussion at NACBA’s Annual Convention. The National Consumer Bankruptcy Rights Center (NCBRC) is a 501(c)(3) organization dedicated to protecting the integrity of the bankruptcy system and preserving the rights of consumer bankruptcy debtors. NCBRC provides assistance either by working directly with debtors’ attorneys or by filing amicus briefs in courts throughout the country. Consider supporting NCBRC today!

Each NACBA member receives FREE, as part of his/her membership, access to Fastcase’s bankruptcy database, including opinions of: (i) the U.S. Supreme Court from 1 U.S. 1 to the present; (ii) the Federal Courts of Appeal from 1 F.2d 1 to the present; (iii) the Federal District Courts from 1 F.Supp. 1 to the present; and (iv) the Bankruptcy Courts from 1 B.R. 1 to the present.
