Description: The most common objection to discharge is found in Section 523(a)(2) of the Bankruptcy Code for fraud. The panel will discuss and explain the two categories of fraud in Sections 523(a)(2)(A) & (B), review caselaw over the past 12 months, explain the effect of the recent Supreme Court case of Bartenwerfer v. Buckley, 143 S. Ct. 665 (2023) on the liability of spouses and partners, and suggest strategies to defend against claims of fraud in non-dischargeability proceedings.

Agencies Will Continue to Assess Whether Process is Providing Relief to Eligible Borrowers
 
WASHINGTON – The Justice Department, in close coordination with the Department of Education, announced today a successful first year of the new process for handling cases in which individuals seek to discharge their federal student loans in bankruptcy. One year after Associate Attorney General Vanita Gupta announced the process in November 2022, data and information show that the process is achieving its goals of ensuring consistency and equity in the evaluation of student loan discharge requests, and that the process has translated into increasing numbers of eligible federal student loan borrowers seeking and obtaining debt relief under the Bankruptcy Code.

Won by NACBA member Mike Miller of The Semrad Law Firm, LLC in Chicago, IL, In re Cooke allows the post-confirmation surrender of a car in a plan. The issue is one that has caused a split in the case law, and the only circuit case that has ruled on this issue, In re Nolan, 232 F.3d 528 (6th Cir. 2000) which was rejected.
