Description: The most common objection to discharge is found in Section 523(a)(2) of the Bankruptcy Code for fraud. The panel will discuss and explain the two categories of fraud in Sections 523(a)(2)(A) & (B), review caselaw over the past 12 months and explaining, the effect of the recent Supreme Court case of Bartenwerfer v. Buckley, 143 S. Ct. 665 (2023) on the liability of spouses and partners, and suggest strategies to defend against claims of fraud in non-dischargeability proceedings.

During Nov. 7's discussion, the Education Department (ED) asked negotiators for feedback on how they can better ensure borrowers who need relief, receive it. 
 
Among the different ideas for how to make relief automatic, negotiators suggested ED immediately discharge loans for:
 
Borrowers with bankruptcy forbearance on file
Borrowers in default
Borrowers who received Pell grants
Borrowers eligible for subsidized insurance under the Affordable Care Act
Borrowers who receive SNAP benefits (food stamps)
Borrowers who have a disability
Borrowers who are in prison
Borrowers who have experienced homelessness 
Seniors

NACBA’s team of legislative advocates in Washington, D.C., assists the Board of Directors to ensure that the voices of consumer debtors and their attorneys are heard in debates about proposed changes to the Bankruptcy Code.
