The Fifth Circuit held that the bankruptcy court improperly required a chapter 13 debtor to amend his plan to pledge 100 percent payment to unsecured creditors with no right to modify unless the modification likewise paid 100 percent or the debtor relinquished his right to discharge. Brown v. Viegelahn (In re Brown), No. 19-50177 (5th Cir. June 8, 2020).
Bob Lawless estimates that in the U.S. around 10 percent or 33 million people have filed a bankruptcy case at some point in their lives. Taking data from the Federal Judicial Center's Integrated Database for bankruptcy petitions Lawless asked for a count of the number of petitions each year from 2009-2018 where the debtor was an individual and had not filed bankruptcy previously, and how many of those cases were joint cases (filed with a spouse) to get a count of human beings and not cases. The results showed 11,709,609 individuals filed bankruptcy from 2009-2018.
