Jurisdiction: 9th Cir.
Date: 10/14/2025

Holding: The Ninth Circuit held that claim preclusion did not bar a debtor from amending his Schedule C to claim a federal exemption after his prior state exemptions were denied. The court also held that the bankruptcy court did not exceed its authority by granting a wildcard exemption even though the debtor misidentified the relevant subsection on the form.

Remember a case but can’t recall the name? Fastcase’s Advanced Search has you covered AND your NACBA membership includes full access to Fastcase’s Advanced Search.

Picture this: You vaguely remember a case about ghosts, poltergeists, and caveat emptor—but you can’t remember the case name or citation. With basic search, you’d spend hours scrolling through irrelevant results.

With Fastcase’s Advanced Search feature, it takes seconds:
1. Open Advanced Search
2. Filter to the jurisdiction (New York)
3. Select “Cases” as content type
4. Enter exact phrase: “caveat emptor”
5. Add keywords: “ghost, poltergeist”

The result? One case: Stambovsky v. Ackley, the famous Ghostbusters ruling where a New York court declared “as a matter of law, the house is haunted.”

Advanced Search lets you combine jurisdiction filters, content types, exact phrases, and keywords to pinpoint exactly what you need—even when your memory is fuzzy.
