AGC Houston accepting applications for Leadership AGC Class of 2017
In 2015, AGC Houston launched an immersive development program that helps participants become transformative leaders. To date, close to 30 individuals—earmarked by their companies as up-and-coming leaders—have taken the interactive course. During the eight-month program, participants gain a better understanding of the responsibilities and qualities that leaders need to successfully shape AGC and the Houston commercial construction industry. The U.S. Supreme Court issued a ruling that will allow the construction and development industries with a way to respond immediately to overly aggressive assertions by the federal government that the property they want to build contains jurisdictional "Waters of the United States" (WOTUS).
AGC was the only trade association to advance the commercial construction industry’s interest in the outcome of this case and, once again, AGC has succeeded in changing facts on the ground. This decision will have a material impact on the way that the Section 404 permit program actually functions.

On June 15, 2016, AGC of America and seven other trade associations jointly filed an amicus brief with the U.S. Court of Appeals for the D.C. Circuit in the Browning-Ferris Industries case concerning the definition of "joint employer" under the National Labor Relations Act. The brief supports Browning-Ferris Industries’ appeal of the August 2015 National Labor Relations Board decision (link is external) expanding that definition.

Thirty-nine states added construction jobs between May 2015 and May 2016 while construction employment only increased in 19 states between April and May, according to analysis of Labor Department data released June 17 by Associated General Contractors of America.
"With construction demand remaining high and construction unemployment getting lower, the slowdown in monthly hiring probably has a lot more to do with a lack of workers than it does a lack of work," said Ken Simonson, chief economist for the association. "Overall the construction market appears robust and as long as most firms can find qualified workers."

Houston foundation repair company pays nearly $100K in back wages, liquidated damages to 30 workers after U.S. Labor Department investigation A U.S. Department of Labor Wage and Hour Division investigation found MMM Foundation Repair violated the overtime and record-keeping provisions of the Fair Labor Standards Act. Investigators determined the employer misclassified employees as independent contractors, and paid them flat-day rates without regard to how many hours they worked. Violations resulted when these employees worked more than 40 hours in a week and the employer failed to pay them overtime. MMM Foundation Repair also failed to keep time or payroll records for some employees, as required by FLSA. The resolution? MMM Foundation Repair paid $49,980 in back wages and an equal amount in liquidated damages, for a total of $99,960 to 30 employees. The company also agreed to keep proper records and comply with all provisions of the FLSA in the future.
