During each election year, the HBA distributes a Judicial Preference Poll before the general election, asking members to indicate their preferences for judicial candidates in contested races. In non-election years, the HBA conducts its Judicial Evaluation Questionnaire, in which members are asked to evaluate all elected and appointed judges on a number of professional and ethical questions. 

 

The 2018 Judicial Preference Poll includes Democratic, Libertarian and Republican candidates in contested races for the Supreme Court of Texas, the Court of Criminal Appeals, the Houston Courts of Appeals, Harris County DistrictCourts, Harris County Courts at Law, Probate Courts, Justice Courts, Attorney General, Harris County Judge, Harris County District Clerk, and Harris County Clerk.

Last week the U.S. Court of Appeals for the Eleventh Circuit affirmed a lower court’s order quashing an administrative warrant for the inspection of a poultry processing plant. USA v. Mar-Jac Poultry, Inc., No. 16-17745 (11th Cir. 2018). The Court concluded that the mere recording of work-related injuries or illnesses does not mean that they were the result of a violation of an OSHA standard, rule or regulation.  As such, recorded injuries or illnesses don’t "justify the issuance of an administrative warrant for evidence of OSHA violations."

OSHA's proposed $304,130 fine against Lanford Bros. in Marion, Va., for silica dust exposure violations is the largest OSHA fine since May, underscoring the importance of compliance with the new silica dust exposure standard. OSHA also has proposed $202,201 in fines for JK Excavation & Utilities for citations after a trench collapse that killed an employee.

On Sept. 13, Congress passed a Fiscal Year (FY) 2019 appropriations bill?which the president is expected to sign into law?that will provide significant amounts of funding for military construction projects through the U.S. Army Corps of Engineers (USACE) and Naval Facilities Engineering Command (NAVFAC); hospital, medical clinic and cemetery projects through the Department of Veteran Affairs (VA); and harbor maintenance, lock, dam, levee and environmental restoration projects through the USACE Civil Works Program.

AGC Texas Building Branch announced the retirement of Mike Chatron at the end of this year. Chatron worked at AGC TBB for 25 years and served as the organization's president for the last decade. Corbin Van Arsdale, General Counsel, will serve as president moving forward. 

 

"Mike Chatron has poured a good chunk of his life into helping AGC and the Texas commercial building industry. And he's done it with excellence, class, and respect. It has been an honor and a true joy to work with him," stated Van Arsdale."

It is with sadness that AGC Houston learned of the passing of James M. Stone, just one day short of his 91st birthday on September 16, 2018 in Austin. Stone became an AGC Houston Honorary Life Member in 1986. 

 

Mr. Stone was born and raised in Houston and founded Stone Construction Company in 1958.  In 1987, he retired from construction and pursued avocations in golf, church and Masonic Lodge.  He and his wife, Karen, moved to Austin in 2009, to be closer to immediate family. According to his stepson Stephen Harp, "throughout his retirement, he often shared fond recollections of his experiences in construction.  As one of Jim’s family, I can say that we are proud of his Honorary Lifetime Membership with the Houston AGC."

 

Patrick J. Kiley, Managing Director, FMI Corporation, reflected on the sad news: 

"I remember Jim fondly. He was a an alumnus of Farnsworth and Chambers, a first class gentlemen and a fine contractor who did mid-range projects.He had poise and presence, reserved, but with a warm and engaging smile when you shook hands."

The National Academy of Construction announced that it has elected Chuck Greco, Chairman of Linbeck Group, LLC, as a member of its class of 2018. Greco was formally inducted on October 11, 2018 during the NAC annual meeting. The 2018 class includes 37 new inductees and more than 300 leaders were considered for the selective NAC election process.

 

During the induction, Greco was noted as a proven industry leader with vast experience at the project and executive levels, with noteworthy achievements in the industry and with professional boards.

 “Chuck Greco, among his many contributions, helped Linbeck develop one of the industry’s model safety programs,” said Wayne Crew, General Secretary of NAC. “His achievements bring added expertise to the academy.”
