Breach Of Contract Bill Gets Heavy Lift With Action From AGC Members

AGC Texas Building Branch would like to extend thanks for those successful efforts.

House Bill 1124, by Rep. Paul Workman (R-Austin), had been left pending in the unpredictable House Calendars Committee last week until being considered Wednesday and set for a full House vote today, May 12. This late in the session, it was crucial that this major AGC bill get set for a vote this week.

As a follow up to last session's successful efforts to abolish state sovereign immunity, HB1124 conforms state law for breach of contract claims to the laws already on the books for counties, cities, school districts and other government entities. Specifically, the bill prohibits owners on a project from banning recovery of attorney's fees and allows recovery for work required by owner's oral change orders. It also allows for recovery of attorney's fees in cases less than $250,000.
