Donald specializes in intellectual property, including copyrights and entertainment. He Is an entertainment expert witness in the media. Donald is the CEO of Digital Economics, a company that uses its expertise in copyright law, media and copyright, economics, and data analytics to address issues involving royalties, residuals, licensing, and metadata associated with audio and visual creative content in advertising, programming and editorial. Generally speaking, court rules prohibit a witness from testifying to their own opinions or analyses. Witnesses are expected to stick to the facts of what they saw, heard, or otherwise experienced. Understanding the laws that govern expert witness testimony can help experts clarify their approach. It can also help experts prepare for challenges and provide the context and insight for attorneys who retained their services. The Depp-Heard trial was the latest courtroom battle to call attention to the gainful microeconomy of expert witnesses. Expert witnesses are used, to some degree, in approximately 8 out of 10 trials in the US. Over the past 50 years, they’ve become increasingly more prevalent in the courts, and often hold great sway over judges and jurors. But little is known to the general public about how they’re sourced and how much they’re compensated for their contributions. Even many experienced experts are guilty of perpetuating communication behaviors that are not at all ideal for either their own credibility or for the fact-finders’ understanding. Calendar of Events
