Trying a case before a jury is no small task. As the saying goes, it is not what you know, it is what you can prove. But to take it a step further, it is also what you can explain. Even a strong case with ample evidence requires a compelling presentation before a jury to obtain a favorable outcome. In cases that require expert testimony, this can be particularly challenging.

Digital forensics is a branch of forensic science that focuses on recovering and analyzing information stored on electronic devices, including computers and cellphones. Digital forensic experts collect, preserve, validate, analyze, interpret, and report data that they find on digital devices.

Rule 702 is now slated to undergo another significant amendment. The change will reemphasize the governing standard of admissibility as well as the importance of reliability in the expert’s opinion. Last year, the Advisory Committee on Evidence Rules unanimously approved the proposed amendments. Furthermore, the comment period for the amendments has recently closed. If enacted, the amended rule will take effect by Dec. 1, 2023.

A variety of circumstances can arise that would preclude an expert witness from testifying at trial. Experts tend to get excluded in federal court for one of two reasons: either the witness disclosure does not comply with the requirements under the Federal Rules of Civil Procedure, or the expert fails to meet the standards for admissibility set forth in the Federal Rules of Evidence. At times, more unique circumstances arise that can prevent an expert witness from testifying.
