The Forensic Expert Witness Association (FEWA) is the only non-profit professional membership organization that verifies that each of its professional members has testified at least three times as an expert witness. FEWA is dedicated to the professional development, ethics and promotion of forensic consultants in all fields of discipline. Have you ever thought about doing expert witness work? Expert witnesses find the rewards are bigger than the nice supplemental income. There are at least three other reasons to round out your professional life with expert witness consulting in the legal arena. Professionals that expand their activities to include expert work report that they found hidden benefits they hadn’t thought about before they threw their hat in the ring.

Forecasts and reports have painted an optimistic picture of this industry's future prospects. The expert witness consulting services industry is booming. Over the past 10 years, the industry has seen a huge increase in demand for services that has resulted in an increase in market size of roughly $200 million.

A recent federal court ruling in the Northern District of Florida, handed down in January (and somewhat overlooked in light of the following day’s news of the retirement of Justice Breyer), temporarily ordered the University of Florida to allow its professors to provide expert testimony in lawsuits involving state government matters (or signing amicus briefs in similar matters). The university’s policy permitted professors to act as experts in cases not involving or being critical of the state but silenced those who would opine potentially ‘adversely’ to the state’s interests. Most likely, this ruling will be upheld as permanent, addressing inconsistent conflict of interest policies – technically called viewpoint discrimination.

The plaintiff sued Sanofi U.S. Services, Inc. and Sanofi-Aventis U.S., LLC in the Eastern District of Louisiana. This individual lawsuit was a part of the Taxotere (Docetaxel) Products Liability Litigation, MDL 2740, consisting of consolidated claims of alleged failure to warn users of Taxotere — a chemotherapy medication — of the risk of permanent alopecia or hair loss as a side effect. The U.S. Circuit Court of Appeals for the Fifth Circuit overturned a jury verdict in favor of the defendants on the grounds that Sanofi “effectively smuggled inadmissible opinion testimony” into the trial (Earnest v. Sanofi U.S. Services et al, No. 20-30184, 1, 17 (5th Cir. Feb. 10, 2022)).
