Proposed amendments to Federal Rule of Evidence 702 could bring much-needed uniformity to the admission of expert witness testimony, say Patterson Belknap Webb & Tyler litigation partners Michelle M. Bufano and Rachel B. Sherman and associate Megha Hoon. Inconsistent understanding and application of the current rule by federal courts weaken the decision-making process for admission of expert testimony and encourage forum shopping, they say.

Senator Scott Wiener (D-San Francisco) has introduced new criminal justice reform legislation, Senate Bill 467. This bill would amend the standards used for evaluating expert testimony and forensics in court pre- and post-conviction. The bill says expert testimony that fails to rely on sound logic should not be considered in court. SB 467 clarifies the definition of false testimony. This legislation also strengthens the grounds on which people can seek post-conviction relief if they have been wrongfully convicted based on unreliable expert testimony. 

The plaintiff retained a psychiatry expert witness to determine the mental health and medical implications of his nearly three-year criminal defense. The expert opined on the plaintiff’s medical and behavioral disorders resulting from the criminal defense. The defendants claimed the expert was unqualified to testify on psychiatric conditions involving adults. Read the full story below.
