Claudia Lezell has been in the floor covering industry since 1983 and has also owned and operated a full-time retail floor covering and interior design establishments for more than 12 years. Claudia holds a degree in deaf education and her years of teaching experience has exposed her to several methods of teaching techniques. She is also an approved IICRC instructor and still instructs the IICRC Hard Surface Inspection curriculum. Whether a physician or other medical provider is sufficiently qualified to testify as an expert is a multifaceted issue. Each state has its own requirements in determining whether a witness qualifies as an expert. Some jurisdictions require potential medical experts to engage in “active clinical practice” before rendering any opinions.

When taking on a case as an NP expert witness, it is important to note that if you work and practice in a state that does not have full practice authority, you likely will not qualify as an expert on a case in a state that has full authority.

Courts and rule-makers have categorized expert witnesses in ways that can be confusing. Placing an expert witness into the correct category can make the difference between a lawyer’s ability to use an expert at trial and a judge’s decision to exclude the expert’s testimony.

It’s crucial to understand the Federal Rule of Civil Procedure 26(a)(2)(B) when writing your expert witness report. If you fail to comply with the requirements, you run the risk of the court excluding your testimony altogether.

The purpose of expert medical witnesses is to provide information on a subject that a judge or jury may not have intimate knowledge. This can be during either a civil case or a criminal case. Expert witnesses are often used for medical malpractice cases as they fully understand the law and best practices of practicing medicine.

The CFLC credential recognizes that certificants are familiar with duties and responsibilities of providing forensic, consulting and expert witness services in litigated claims. Additionally, the CFLC credential signifies that in addition to meeting FEWA's experience and membership requirements, these CFLCs have further met minimum continuing education requirements in the CFLC Core Program.
