The easy answer here is yes – hire the expert witness. Expert witnesses bring great value to the table. They pack that extra punch – they bring forth the facts, the research, and the knowledge that is only possessed by a true expert. Expert witnesses have valuable insight that you won’t find anywhere else. With their testimony, you are more likely to settle your case quickly. Out of all the types of evidence that can be presented, expert testimony is among the most powerful. 

Solving the causes of building defects in the high rise multi-apartment sector is becoming more and more complex. Legal cases need better integrated assessment of expert input. Often building related building defect cases are much more complex than they appear and need more than one expert type to understand and solve the issue.

When an attorney retains an expert on a case, the expert’s opinion typically will culminate in an expert report. Rule 26(a)(2)(B) of the Federal Rules of Civil Procedure mandates disclosure of the expert report to opposing counsel. The report summarizes the expert’s opinions and includes the facts on which the expert relied. Additionally, the report consists of the expert’s qualifications and credentials, among other items. Although Rule 26 governs expert reports in federal courts, similar rules apply in at least 35 state jurisdictions as well. Opposing counsel may use the report to challenge your credibility as an expert or your opinion’s reliability. As such, it’s important to thoroughly document your qualifications

A medical malpractice case involving the death of a four-year-old boy made it to the Arizona Supreme Court. The issue: whether the plaintiff and their medical expert established causation. The outcome of the case is a stark reminder of the importance of expert witness testimony during medical malpractice cases. Experts are a necessity in a vast majority of cases. They need to be prepared to offer clear, accurate, and comprehensive testimony regarding the standard of care and causation.

If expert witnesses contradict each other on a legal matter at issue, should courts exclude their opinions? In a recent case, the ruling judge said no, stating that differing expert opinions are not necessarily mutually exclusive. Indeed, even if conflicting opinions are presented, expert testimonies should supplement each other. Once given, it is up to the jury to determine their significance.
