Psychologists are mental health professionals that use psychotherapy and behavioral interventions to treat patients with mental and emotional suffering. Because of the array of psychology subspecialties, psychology expert witnesses can opine on a wide variety of cases.

When the Supreme Court set the standard for expert testimony admissibility in Daubert v. Merrell Dow Pharmaceuticals, Inc., 509 U.S. 579 (1993), it upended decades of prior case law interpretation of what it means to be an expert. In light of the decision’s enormity, Rule 702 of the Federal Rules of Evidence was subsequently amended seven years later to more directly conform to Daubert’s holding.

If you wanted to know about rocket ships, who would you consult: your next-door neighbor, or a NASA engineer? Unless your neighbor has some remarkable qualifications, you would probably pick the engineer. Why? Because presumably the right information is important to you, and the engineer is an expert.

Experts in medicine can command thousands of dollars when they testify in American courtrooms, but prosecutors made a point of letting jurors know that Dr. Martin Tobin was not being paid for his appearance Thursday at former Minneapolis police Officer Derek Chauvin’s murder trial.

It’s not easy getting a drug or device to market. From concept to launch, it takes years of work and the involvement of countless professionals from the engineering, medicine and regulatory disciplines. If the product becomes the focus of a product liability action, both sides of the litigation must rely on expertise from these disciplines to support or defend the case. Indeed, most cases require expert testimony to pursue a personal injury claim, and a plaintiff lacking expert testimony might see the case dismissed on summary judgment.
