FEWA member, James R. Jauchem, PhD, is the principal of Forensic Pathophysiology, LLC. Dr. Jauchem received his doctorate degree in physiology from Baylor College of Medicine in Houston, Texas. With 40 years of research experience in pathophysiology, his last 10 years were specifically related to conducted electrical weapons (including TASER® devices) and other potential non-lethal weapons (including acoustic devices and blunt-impact projectiles). Expert witnesses have become increasingly valuable when litigating a legal case. But fees can be burdensome, particularly for small or midsize firms and especially during lengthy or complex litigation. Instead of forgoing a necessary component of your case—or putting it off until the last moment—check out the below three ways to keep expenses reasonable when consulting with an expert.

For experts and attorneys, retainer agreements are an important component of the legal working relationship. The retainer is an up-front, lump-sum paid by the hiring attorney for the projects they want an expert to complete. For experts, a retainer agreement is a seamless payment option—you’re paid right away without the need for invoicing. The attorney also benefits by avoiding the tedious task of ongoing bill reviews and payment approval processes. The foundation of an expert retainer arrangement, of course, is an agreement on the amount of the retainer. Reaching this consensus isn’t rocket science but does require clear communication and expectation management.

Three years ago my ex-colleague Adam Cadwaladr wrote a fantastic blog titled ’12 points to assess whether expert witness work is for you’.
