The 2021 National Officers and Board of Directors was confirmed on December 11, 2020. The 2021 Officers and Board are eager to serve FEWA and its members, representing both the National Organization and our local Chapters. Your Board is an advocate for expansion of member benefits, strategic initiatives, and spreading the value of FEWA to fellow experts, consultants, attorneys, and others in the industry. The Board is looking forward to a successful 2021!

FEWA Member, Melanie Modica is an Accredited Senior Appraiser for personal property, fine art, with the American Society of Appraisers. Additionally, she holds an Appraisal Review & Management (ARM) designation for reviewing personal property appraisal reports. Melanie is a leader in the personal property appraisal profession as currently 1 of only 4 fine art appraisers to hold the ARM designation in ASA. She is currently the only ASA personal property ARM appraiser in the entire south region, and offers desktop reviews nationwide. Read more about Melanie below.

If a medical expert has been compensated by an attorney, their law firm, or a party’s liability insurance company multiple times over the past few years to provide testimony, be ready for opposing counsel to seek discovery on those issues and to present evidence of those matters at trial. Opposing counsel may use this information to their advantage at trial to show the potential for bias by cross-examining the expert on his/her relationship with the liability insurance carrier or the plaintiff or defense counsel’s law firm.

As every attorney, judge, and—most importantly—jury knows, the most critical characteristic of an expert witness offering testimony is their credibility. An expert could be the most qualified in their field, but it means nothing if the jury does not believe them. Especially in cases where opposing expert testimonies are facing off, the jury’s interpretation can become a credibility challenge.

A federal appellate court in Iowa recently upheld a plaintiff expert witness’s exclusion in a workplace product liability case for their failure to satisfy the requirements of Federal Rules of Evidence 702. The decision in Hirchak v. W.W. Grainger, Inc., No. 19-2642 (8th Cir. Nov. 17, 2020) amplifies the importance, per Rule 702, for experts to base their opinions on sufficient facts, including accounting for obvious alternative explanations. The ruling also reminds experts to keep their opinions within their area of expertise when participating in legal matters.
