Brian is an experienced computer technologist who has testified at trial 8 times, been deposed 20 times, and has written 31 Expert Reports and 4 IPR declarations. His engagements have involved patents, trade secrets, copyrights, class actions, medical malpractice and patent portfolio reviews. He has extensive experience with consumer electronics, storage technology, Flash Memory, interfaces including USB, SATA and SCSI, file systems, Optical Storage (CD, DVD, Blu-ray), Magnetic Storage (Disk and Tape), cloud storage, data compression and encrypted data. His work has involved device teardowns, source code analysis, object code disassembly, hardware design analysis, benchmarking, computer media forensics and file system analysis. Read more about Brian below.

As a lawyer, you may find that the expert you’re deposing has been deposed many more times than you have taken a deposition. A good first questions to ask an expert is, “How many times have you been deposed?” The answer to this question sets the next series of questions.

In a recent set of post-trial juror interviews, the jurors we spoke to detailed how the believability of the plaintiff’s expert witness had them strongly favoring the plaintiff. …That is, until the defense attorney caused the expert to fall apart on cross-examination. They described the experience of watching this attorney dismantle the witness as akin to being in court with Perry Mason – and had referred to the attorney by that very name for the rest of trial.

As expert witnesses, we are often juggling many roles and it is this variation that encourages us to remain resilient in challenging times. Through adapting our approach to work, it may be that we can remain positive in light of this threat.

An expert witness (EW) should, first and foremost, be considered to have expert knowledge relating to the particular subject matter of his/her field, but the role is evolving.
