The New York Supreme Court case of Caminiti v. Extell serves as a prime example of how labor law expert witness testimony regarding safety standards and statutory requirements can decisively influence liability determinations in complex workplace injury litigation. (Expert Witness Blog)

An examination of "ephemeral evidence" highlights how expert witnesses must serve as the primary recorders of transient phenomena—such as disappearing digital data, fading odors, or volatile AI outputs—by prioritizing rigorous methodology and real-time documentation to ensure such "invisible" evidence remains admissible in court. (Round Table Group)

To serve as effectively as possible and help shape courtroom outcomes, expert witnesses need to fully understand the importance of their highly specialized roles, understanding how their input differs from that of regular witnesses, while adhering to strict legal standards of admissibility and ethical objectivity. (Science Insights)

Two recent Federal Circuit decisions, Willis and Exafer, have further refined the court’s Daubert gatekeeping framework by clarifying that district courts may evaluate an expert’s reliability based on their full report and that patent damages models may include non-accused product sales if a sufficient causal connection is established. (JD Supra)

With AI-generated evidence and testimony becoming an ever-more present tool at the forensic expert witness's disposal, it's vital that a rigorous chain of custody is maintained to ensure authenticity and admissibility in court, as it protects the integrity of the data from the moment of collection through its presentation in legal proceedings. This presentation is to describe and explain an acronym that is used by attorneys to set up their cross examinations, C-R-O-S- S.
• C: Destruct the expert's credibility
• R: Restrict the expert's answers
• O: Elicit outrageous statements from the expert
• S: Use prior statements from the articles written, lectures, or Facebook statements that do not agree with opinions presented in the current case
• S: Solicit statements that support their case

For the roleplay section, Dr. Spankovich will play the role of the cross examination attorney attempting to follow the CROSS acronym and Dr. Colucci will be the expert witness on the stand working to honestly present the truth. After the instruction and role play, the presenters will summarize the points presented and answer questions by the participants.
