The Small Business Administration released a new Frequently Asked Questions (FAQ) document on PPP loan forgiveness. This document addresses a few general questions on loan forgiveness, but predominately deals with very specific questions related to the calculation of both payroll and non-payroll-costs for PPP forgiveness.
The Industrial Truck Association (ITA) issued the following note on potential tariffs from the European Union:
 
The United States Trade Representatives (USTR) Office released their final determination/list of products subject to additional tariffs originating from select European Union countries. No forklift related products were on the list and this was also confirmed by USTR Counsel (please see attached federal register announcement).
 
The Trump Administration on June 26, 2020 published a list of $3.1 billion worth of European goods that could be subject to U.S. retaliatory duties in a long-running dispute over European government subsidies for Airbus. (FYI - the US already has retaliatory duties on $7.5 billion worth of European goods in the dispute. It took that action after receiving authorization from the World Trade Organization).
 
This review was required by Congress under a trade law provision known as "carousel," which requires the U.S. Trade Representative to review any WTO-sanctioned retaliation list every six months for possible changes. This review will take place again in 180 days and we will continue to monitor developments.

The NAW Issued the following critical update relating to the Employee Payroll Tax Deferall Executive Order:

 

On Friday evening, the Treasury/IRS finally released official guidance on the payroll tax deferral Executive Order, scheduled to take effect tomorrow, September 1st.  Unfortunately, the guidance fails to address some of the concerns NAW and others expressed in our letters to Treasury and leaves critical questions unanswered.  

 

The guidance:

 

 ·        Clearly identifies employers as the taxpayers even though it is the employee’s portion of the payroll tax that would be deferred;

 

 ·        Apparently makes the program voluntary for employers, not by clearly stating that it is but by the absence of language making it mandatory;

 

 ·        Does not have any language giving employees the right to choose whether or not to participate, leaving the decision on whether to do so solely with employers;

 

 ·        Would apply the tax deferral to biweekly wages of $4,000 or less, calculated on a pay period basis, apparently obligating the employer to determine for which pay periods the tax could be deferred if an employee’s pay was over $4,000 in some pay periods but under $4,000 in others;

 

 ·        Requires the employer to withhold and pay any 2020 taxes deferred under this program beginning on January 1 – April 30, 2021, resulting in employees paying double the payroll tax for those four months;

 

 ·        Leaves unanswered the question of how an employer handles the deferred taxes from an employee who has left the company, other than stating that “if necessary, the Affected Taxpayer may make arrangements to otherwise collect the total Applicable Taxes from the employee;” and

 

 ·        Also leaves unanswered the question of who is responsible if an employer is unable to collect the deferred taxes from a former employee.

 

NAW is cautioning members to be very careful before deciding to participate in this program because businesses that defer their employees’ payroll taxes now will be required to withhold the deferred taxes from their employees in the first four months of 2021 – in addition to their regular withholding – leaving those employees with what would be an unanticipated reduction in take-home pay.  We urge businesses to consult with your tax advisors before deciding to participate.

On the Bright Side

Meet Kerith - a certified crisis response therapy dog offering comfort and support to firefighters in California.

This 2-year-old golden retriever has met firefighters daily at the wildfire base camp in Marin County for th past few weeks, calmng them and putting smiles on their faces during and after their morning briefings.

Kerith's handler, Heidi Carman, told TODAY that the pup helps the firefighter "by just letting them be with her, and they don't have to say anything."

She continued, "They've told me that Kerith makes them feel important, loved and special."

Kerith has started sitting in on debriefing meetings following tough calls for the team to help calm them after what's many times a traumatizing experience.
