CTA in Action: Government Affairs Update
As you know, on November 12th, CTA filed its amended complaint challenging AB 5
Last week, CTA filed a preliminary injunction with the Southern California District Court seeking relief from AB 5 and its impact on independent owner-operator trucking. If granted, the preliminary injunction will preserve the status quo, allowing the industry to continue operating "as is" until the court rules; however, to secure the injunction there are several hurdles to jump.
Revised Form Requires New Information From Carriers
Effective August 1, 2019, the California Department of Tax and Fee Administration (CDTFA) imposed new reporting requirements for common carriers transporting alcoholic beverages, including liquor shipments from out-of-state licensed distributors to licensed distributors (importers) into California. The new Common Carrier's Report of Delivery report now requires carriers to include “Kind Codes,” a “Mode Code” and the licensed importer's (i.e., the shipment recipient’s) CDTFA account number.
This week, the California Air Resources Board (CARB) will hold a hearing on the proposed the Advanced Clean Trucks (ACT) Regulation. The ACT regulation has two main components: a manufacturer sales requirement and a large business entity and fleet reporting requirement.  Under ACT, manufacturers who certify Class 2B-8 chassis or complete vehicles with combustion engines will be required to sell zero-emission trucks as an increasing percentage of their annual California sales from 2024-2030; ultimately reaching 50% of class 4-8 straight truck sales and 15% of all truck sales by 2030.
