Government Affairs Update
 
The American Transportation Research Institute (ATRI), the trucking industry’s not-for-profit research organization, launched the 2022 Top Industry Issues Survey. The annual survey asks trucking industry stakeholders to rank the top issues of concern for the industry along with potential strategies for addressing each issue.
 
Since 2005, ATRI's Top Industry Issues Survy has served as a unique and vital tool for the trucking industy. Now in its 18th year, this annual analysis not only ranks the issues overall but it also provides insights into how critical topics are ranked differently by motor carriers and professional drivers. The report also allows stakeholders to monitor issues over time to better understand which issues are rising, or falling, in criticality.
 
Just a few minutes of your time will provide valuable information to ensure the long-term health of the industry.
 
Industry stakeholders are encouraged to complete the 2022 Survey before the Friday, October 7 deadline.
In May 2021, the South Coast Air Quality Management District (SCAQMD) approved the Warehouse Indirect Source Rule (ISR) to regulate emissions associated with warehouses greater than 100,000 square feet located in the South Coast Air Basin.
 
By now either your business or your organization’s members have likely started to grapple with the immense cost and administrative burdens imposed by this rule, which are estimated to cost approximately $1 per square foot of warehousing space annually. 
 
We believe this rule represent an unconstitutional tax and authority grab that sets a dangerous precedent that will spread to other air quality districts in California, other states and potentially nationwide!
 
We have the opportunity to stop an out of control government agency from unlawfully regulating truck emissions and imposing billions of fees on the logistics industry. 
The California Air Resources Board (CARB) is hosting a public advisory meeting to discuss updates to the Carl Moyer Program (program) for heavy-duty vehicles:

Time: 4:00 PM – 7:00 PM
 
The program provides funds to operators replacing heavy-duty vehicles with cleaner equipment. During the webinar, CARB will review staff’s proposed changes to the program including increased voucher funding for zero-emission vehicles in response to the state’s goal to electrify fleets. We highly encourage members to participate in the Zoom webinar.

Three circumstances require you to do a post-accident drug and alcohol test according to FMCSA regulations. 
  1. A test always is conducted on a surviving driver when an accident involving a commercial motor vehicle results in a fatality. The driver does not need to be cited for a moving traffic violation, nor does the driver need to be deemed at fault. If a fatality occurs, the driver is tested.
  2. A test must be conducted if the driver receives a citation for a moving traffic violation and one or more of the vehicles involved in the accident is towed from the scene of the accident; OR
  3. The driver receives a citation for a moving traffic violation, and one or more persons involved in the accident immediately receive medical treatment away from the scene of the accident.
     
What are the time limits for conducting these tests? 
The alcohol test should be conducted within two hours of the accident and the drug test within 32 hours of the accident. If the alcohol test is not performed within two hours, the employer should continue to make an effort to have the driver tested for up to eight hours and prepare and maintain, on file, a record of why the test was not administered. If a drug test is not conducted within 32 hours of the accident, the employer shall cease any attempt to administer a drug test and prepare and maintain, on file, a record stating the reasons why the test was not administered.
 
Must these tests be conducted under the procedures outlined in the 49 CFR, Part 40? 
Yes, with one exception. A urine specimen must be submitted for a drug test and a breath specimen for the alcohol test. The exception is if a law enforcement officer investigating the accident has reasonable suspicion to believe that a driver is under the influence of drugs and/or alcohol, the law enforcement official may require the driver to submit to a breath or blood alcohol test.
