Government Affairs Update
 
Assembly Bill 2406 by Assemblywoman Cecilia Aguiar-Curry cleared the Assembly this morning with a final vote of 63 - 1 with 14 members abstaining.
 
This bill, which is co-sponsored by CTA, seeks to protect California businesses from being charged excessive and unfair fees (detention/demurrage) by intermodal marine equipment providers for reasons outside the control of the business by clarifying and modernizing the protections set by SB 45 (Alarcon, 2005).
 
AB 2406 now moves to the Senate where it will be heard by the Committee on Transportation.
 
 CTA government affairs team will continue to work with the Assemblywoman and keep members updated as AB 2406 continues to make its way through the legislative process.
The California Occupational Safety and Health Standards Board (CalOSHA) approved new amendments to the COVID-19 Emergency Temporary Standards for workplace safety.
 
The new revision reflects changes from the Governor’s Executive Order to automatically align workplace standards with CA Department of Public Health (CDPH) requirements and guidance for isolation and quarantine periods.
 
The newly adopted revision went into effect this Saturday, May 7 and will remain until December 31, 2022.
 
A permanent ETS is expected to be in place January 2023.
The Commercial Vehicle Safety Alliance (CVSA) has announced this year’s International Roadcheck dates as May 17-19 with a focus on wheel ends.
 
International Roadcheck is a 72-hour high-visibility, high-volume commercial motor vehicle inspection and enforcement initiative. Commercial motor vehicle inspectors in Canada, Mexico and the U.S. will conduct North American Standard Inspections of commercial motor vehicles and drivers at weigh and inspection stations, on roving patrols, and at temporary inspection sites.
 
Each year, CVSA focuses on a specific aspect of a roadside inspection. This year, the focus will be on wheel ends. Wheel end components support the heavy loads carried by commercial motor vehicles, maintain stability and control, and are critical for braking. Violations involving wheel end components historically account for about one quarter of the vehicle out-of-service violations discovered during International Roadcheck, and past International Roadcheck data routinely identified wheel end components as a top 10 vehicle violation.
The U.S. EPA is proposing new emission standards for heavy-duty trucks that will result in companies and drivers purchasing more expensive vehicles and new changes to speed de-rates that create speed differential and delivery concerns. 
 
In response, the California Trucking Association submitted comments to the formal docket outlining the impracticality of the new rule that will harm the trucking industry and goods movement sector.

Group Asks for Personal Conveyance Limits

The Commercial Vehicle Safety Alliance has petitioned FMCSA for a second time to more clearly define the term “personal conveyance” in hours of service regulations. It is asking the agency to add a maximum distance or time limit to the rules.
