Government Affairs Update
 
The FMCSA announced this morning that it has extended its Emergency Declaration until February 28, 2022. The waivers were previously set to expire on November 30, 2021. 
 
The extensions on the declaration are limited to transportation for the following:
1. Livestock and livestock feed;
2. Medical supplies and equipment related to the testing, diagnosis, and treatment of COVID-19;
3. Vaccines, constituent products, and medical supplies and equipment, including ancillary supplies/kits for the administration of vaccines, related to the prevention of COVID-19;
4. Supplies and equipment necessary for community safety, sanitation, and prevention of community transmission of COVID-19 such as masks, gloves, hand sanitizer, soap, and disinfectants; and,
5. Food, paper products, and other groceries for emergency restocking of distribution centers or stores;
6. Gasoline, diesel, jet fuel, and ethyl alcohol; and, 
7. Supplies to assist individuals impacted by the consequences of the COVID-19 pandemic (e.g., building materials for individuals displaced or otherwise impacted as a result of the emergency).
 
This declaration applies only to 395.3 “Maximum Driving Time for Property-Carrying Vehicles”. This declaration becomes effective at 12:00 a.m. December 1, 2021 and expires February 28, 2022 unless modified or terminated prior to this date.
 
Reporting requirements previously established remain in effect.
 
To be eligible, the transportation must be both (1) of qualifying commodities and (2) incident to the immediate restoration of those essential supplies. We strongly encourage everyone to review the applicability, restrictions, and limitations listed within the waiver.
Over the past few years, San Bernardino County has experienced an increase in the number of fatalities and serious injuries resulting from traffic collisions. To work on preventing the frequency of collisions, the California Highway Patrol’s (CHP) Rancho Cucamonga Area was recently awarded a 12-month grant from California’s Office of Traffic Safety that will focus on a regional public education campaign and enhanced enforcement. The region covers CHP jurisdictional state routes and unincorporated streets and highways within the San Bernardino County. A task force has been created to work on the educational campaign and members of the task force include the CHP, Caltrans, city and county law enforcement agencies and the California Trucking Association. Representing CTA on the Task Force is CTA’s Safety, Security and Human Resources Policy Committee Chairperson Tim Pollock (CPS Express) and CTA Senior Vice President of Government Affairs Eric Sauer.  
FMCSA has extended the CDL and CLP waivers under certain circumstances. Please note, this waiver permits, but does not require, states to extend the validity of commercial driver’s licenses (CDLs) and commercial learner’s permits (CLP) for those issued on or after March 1, 2020, until February 28, 2022. Carriers and drivers should check with their state agencies to ensure compliance, as not all states may extend the validity period.
 
For medical examinations, this waiver waives the requirement that drivers have a medical examination and certification until February 28, 2022, provided they have proof of a valid medical certification and any required medical variance issued for a period of 90 days or longer and expired on or after
September 1, 2021.

FMCSA has also extended waivers related to the California Trucking Association and California DMV led  third-party CDL skills test examiners and CLP holders operating a CMV.
 
FMCSA has indicated their intent to review the status of certain waivers as of January 3, 2022 and may take action to terminate the waivers sooner if conditions warrant.

The Commercial Vehicle Safety Alliance has petitioned FMCSA for a second time to more clearly define the term “personal conveyance” in hours of service regulations. It is asking the agency to add a maximum distance or time limit to the rules.

Nominations are being accepted for the trucking industry’s "pioneers" to participate in the Golden Jubilee Club. Members of this distinguished group meet each year at CTA’s Annual Membership Conference to honor the pioneers of our industry and to introduce new members of the Golden Jubilee Club.

Joe Kent was the Vice President for CTA from 2004-2014. He was an ordinary person who accomplished extraordinary things for our association through selfless acts of service.
This award celebrates Allied members in action, who like Joe, have given generously of themselves for the greater good of our organization over the years. In remembrance of Joe, we have created our highest recognition to be awarded annually at the Annual Membership Conference held each January. The recipient will be honored at the President’s Lunch on Thursday, January 20, 2022 at the Paris Las Vegas, receive a $1,000.00 donation given by the Allied Member Conference that is to be awarded to the CTA activity of the recipient’s choice, and have their name inscribed on a commemorative plaque that will be permanently and proudly displayed at the CTA headquarters in Sacramento.
